Retour Recommendation on the legal status of non-governmental organisations in Europe

Adopted on: 10 October 2007

This recommendation looks at the legal and fiscal framework of NGOs in the member states to ensure they can continue to make a valuable contribution to public and social life. The document recognises different types of NGOs, such as formal (registered) and informal, membership based and those without required membership, established both by individuals and groups. It states that NGOs should be free to pursue their objectives, but they should be consistent with the principles of a democratic society. NGOs should not be subject to direction from any public authority. The document provides guidelines on issues relevant to NGOs, such as: establishment of an organisation, the content of legal documents (statutes), membership, acquisition of legal personality, management, fundraising, public support and accountability. The document includes an explanatory memorandum that explains in detail the content of the recommendation.
