La agresión militar de la Federación de Rusia contra Ucrania, que comenzó el 24 de febrero de 2022, ha cambiado la fisonomía de Europa y ha tenido una profunda repercusión en el Consejo de Europa.
Desde el comienzo mismo de la agresión militar de Rusia, el Consejo de Europa ha estado movilizando todos los instrumentos disponibles para asegurar la plena rendición de cuentas de la Federación de Rusia por las violaciones de los derechos humanos y por las graves infracciones del derecho internacional, así como para indemnizar a las víctimas de la agresión de Rusia.
El Consejo de Europa trabaja actualmente en la creación de un mecanismo integral de indemnizaciones. El primer componente de este mecanismo es el Registro de daños causados por la agresión de la Federación de Rusia contra Ucrania, creado en virtud del Acuerdo Parcial Ampliado del Consejo de Europa. El Registro fue creado en la Cumbre del Consejo de Europa en Reikiavik (Islandia), celebrada los días 16 y 17 de mayo de 2023. Hasta la fecha, 44 países y la Unión Europea se han adherido al Registro como miembros o miembros asociados. El Convenio por el que se establece la Comisión Internacional de Reclamaciones para Ucrania es el segundo componente de este sistema de indemnizaciones, fue firmado desde el primer día por 34 gobiernos nacionales y por la Unión Europea. Este órgano se pondrá en funcionamiento una vez haya sido ratificado por 25 de los signatarios y se haya dotado formalmente de un presupuesto.
El 25 de junio de 2025, el presidente Volodímir Zelenski visitó el Consejo de Europa para firmar un acuerdo histórico junto al secretario general Alain Berset, con el que se creaba un Tribunal especial para perseguir el crimen de agresión contra Ucrania, lo que permite suplir el vacío causado por los límites jurisdiccionales de la Corte Penal Internacional (CPI) y garantizar que los responsables al más alto nivel rindan cuentas por la agresión.
Adversity and perseverance: the Council of Europe’s support for Ukraine’s defence through four years of full-scale war
Since Russia’s full-scale invasion of Ukraine in February 2022, the Council of Europe has been at the forefront of international efforts to defend democracy, human rights, and the rule of law in Ukraine. Over the past four years, the organisation has offered consistent support and practical assistance amid ongoing hostilities.
Immediate response and condemnation
The Council of Europe’s support began with resolute condemnation of Russia’s aggression from across the organisation. On February 24, 2022 the Secretary General, the Committee of Ministers, the Parliamentary Assembly, and the Congress of Local and Regional Authorities all issued urgent statements denouncing the Russian invasion, calling for swift accountability. The Council of Europe suspended Russia’s rights of representation and subsequently expelled that state from the organisation and from the European Convention on Human Rights.
Throughout 2022, the Council of Europe worked with the Ukrainian government to protect civilians, support refugees, and to promote democratic governance. It launched initiatives through the Council of Europe Development Bank (CEB) to assist displaced Ukrainians and bolster health infrastructure, and supported human-rights monitoring and advocacy through the Commissioner for Human Rights.
Human-rights protection and justice
The Council of Europe established the Register of Damage for Ukraine in 2023 as the first step toward an international compensation mechanism for victims of Russian aggression. It has continued to open new categories of compensation claims over time.
The European Court of Human Rights has fast-tracked cases related to Ukraine, delivering judgments on the substance of Russia’s actions on Ukrainian territory, and issuing interim measures to protect prisoners of war, civilians, and vulnerable groups.
The organisation has also led the process for the creation of a Special Tribunal for the Crime of Aggression against Ukraine, culminating in the signing of an agreement in 2025 between Ukrainian President Volodymyr Zelenskyy and Secretary General Alain Berset. Parliamentary Assembly debates and resolutions throughout this period called for comprehensive justice, accountability for crimes, and a just peace for Ukraine.
Protection for children and vulnerable groups
Recognising the catastrophic impact of war on children, the Council of Europe appointed a Special Envoy on the situation of children of Ukraine. The organisation has launched awareness campaigns, facilitated exchanges with the United Nations, and supported urgent humanitarian moves to reunite displaced Ukrainian children with their families.
The Council of Europe has run projects with local authorities to help Ukrainian municipalities enhance resilience, participatory governance, and social protection, focusing on education, trauma-informed care, and youth engagement.
Recovery, reconstruction, and democratic governance
Solidarity was reflected in continuous efforts to support Ukraine’s recovery and reconstruction. Through close cooperation with Ukrainian cities, regions, and civil society, the Council of Europe has facilitated decentralisation reforms, open-government strategies, and capacity building for the return of displaced persons and reconstruction of critical infrastructure.
The organisation pledged significant financial aid via the CEB for restoration of health services and housing, and promoted agreements for the future governance of Ukraine in the post-war period.
International advocacy and unity
The Council of Europe has held summits, conferences, and exhibitions to galvanise European unity and raise awareness of both ongoing suffering and Ukraine’s courage. The Parliamentary Assembly has regularly called for sustained sanctions, support for independent journalism, and solidarity from European institutions.
Statements from the Secretary General of the Council of Europe, the President of the Parliamentary Assembly, and the Congress have reaffirmed that standing with Ukraine is essential to protecting European values.
Four years on: continued support (2026)
On the fourth anniversary of Russia’s war in February 202 the Council of Europe reaffirmed support for Ukraine. Further assistance was pledged, and solidarity extended to Ukrainian communities. The organisation continues to highlight that a Europe tolerating Russian aggression betrays its democratic values.
From condemnation and sanctions to practical humanitarian aid, legislative reforms, and international advocacy, the Council of Europe’s support for Ukraine has been unwavering. Its comprehensive agenda, working in justice, human rights, and democratic governance, among other areas, is designed to help Ukraine resist aggression, rebuild, and secure a just and lasting peace.

Measures changed in respect of cases involving Ukraine
The Court has decided to review the measures applied in respect of cases involving Ukraine since the aggression of the Russian Federation and return in some aspects to normal processing of such cases from 1 September 2022.
Outgoing correspondence with the applicants will resume, in so far as possible, and general information addressed to all applicants will be made available on the Court’s Internet site. Case processing will resume and new time limits will be fixed for pending cases, taking into account as far as feasible the possibilities for the parties to respond effectively. The notification and publication of decisions and judgments will resume gradually.

Request for interim measures concerning an inter-State case
The ECHR has decided that a request for interim measures, in the context of the inter-State case Ukraine v. Russia (X), received from the Ukrainian Government with regard to Ukrainian prisoners of war captured by Russian forces was already covered by a decision taken in the case of Oliynichenko v. Russia and Ukraine.
In that decision, concerning a member of the Ukrainian military allegedly captured in Mariupol, the Court had held that any requests made on behalf of Ukrainian prisoners of war in Russian custody in which sufficient evidence had been provided to show a serious and imminent risk of irreparable harm would be covered by the measures in that case.

Interim measures concerning the Russian Federation and Ukraine
The Court has indicated interim measures in the case of Oliynichenko v. Russia and Ukraine.
In this case, the applicant’s husband is allegedly a prisoner of war being held by Russian forces. The Court indicated that the Russian Government should ensure respect for his Convention rights and provide him with medical assistance should he need it.
The Court also stated that these interim measures cover any requests made on behalf of Ukrainian prisoners of war in Russian custody in which sufficient evidence has been provided to show that they face a serious and imminent risk of irreparable harm to their physical integrity and/or right to life.

European Court of Human Rights
Interim measures granted concerning Russia and Ukraine
The ECHR has granted interim measures in the cases of Pinner v. Russia and Ukraine and Aslin v. Russia and Ukraine.
The cases concern two British nationals, members of the Armed Forces of Ukraine, who surrendered
to the Russian forces during recent hostilities and have since been sentenced to death in the socalled
“Donetsk People’s Republic”.
The Court indicated to the Government of the Russian Federation that they should ensure that the death penalty imposed on the applicants was not carried out; ensure appropriate conditions of their detention; and provide them with any necessary medical assistance and medication. The Court also indicated to the Government of Ukraine to ensure, in so far as it was possible to do so, respect for the Convention rights of the applicants.

The case concerns the Ukrainian Government’s allegations of mass and gross human-rights violations committed by the Russian Federation in its military operations on the territory of Ukraine since 24 February 2022. The President of the Court has assigned the case to the Fourth Section and given notice of the application to the respondent State.

Measures taken in cases concerning the Russian Federation
The ECHR has decided to take a number of measures which will now be applied in all cases concerning the Russian Federation until further notice owing to the disruption to the postal service since the start of March 2022. Exceptions to the above measures can be decided by the President of the Court of his own motion or on request by the parties. These measures will be reassessed in the light of developments in the postal service and will automatically be lifted if the postal service is resumed.

Interim measure concerning the Russian Federation
The Court has decided to apply an urgent interim measure in the case ANO RID Novaya Gazeta and Others v. Russia. The ECHR, in the interests of the parties and the proper conduct of the proceedings before it, and having regard to the exceptional context in which the request has been lodged, invited the Russian authorities to abstain until further notice from actions and decisions aimed at full blocking and termination of the activities of Novaya Gazeta, and from other actions that in the current circumstances could deprive the Russian daily newspaper of the enjoyment of its rights guaranteed by the Convention.

Measures taken in cases concerning Ukraine
Against the background of the war in Ukraine and following a request received from the Ukrainian Government on 24 February 2022 to “suspend the examination of all applications against Ukraine until further notice”, the ECHR has decided to take a number of measures which will now be applied in all cases concerning Ukraine until further notice. The President of the Court may allow exceptions to those measures where appropriate.

The Court has decided to indicate to the Government of Russia to refrain from military attacks against civilians and civilian objects, including residential premises, emergency vehicles and other specially protected civilian objects such as schools and hospitals, and to ensure immediately the safety of the medical establishments, personnel and emergency vehicles within the territory under attack or siege by Russian troops.
