Finland ratified the Revised European Social Charter on 21/06/2002, accepting 88 of the 98 paragraphs of the Revised Charter.

It ratified the Additional Protocol providing for a system of Collective Complaints on 17/07/1998. Finland has made a declaration enabling national NGOs to submit collective complaints.

Finland ratified the European Social Charter and the Additional Protocol to the Charter on 29/04/1991. It ratified the Amending Protocol to the Charter on 18/08/1994.

La réclamation, enregistrée le 29 avril 2014, porte sur l'article 12 (droit à la sécurité sociale), de la Charte sociale européenne révisée. L’organisation réclamante allègue que la Finlande, en cherchant continuellement à réduire la pension de chômage,ne maintient pas le régime de sécurité sociale à un niveau satisfaisant ou s’efforce de le porter à un niveau supérieur, mais le dégrade considérablement, en violation de la disposition précitée.

Le Comité européen des Droits sociaux a adopté sa décision sur la recevabilité et le bien-fondé le 8 décembre 2016.

Dans sa décision sur la recevabilité et le bien-fondé, le Comité :

  • à l’unanimité déclare la réclamation recevable ;

et conclut à l’unanimité :

  • qu’il n’y a pas violation de l’article 12§3 de la Charte ;
  • qu’il y a violation de l’article 13§1 de la Charte.

Le Comité des Ministres a adopté la Résolution CM/ResChS(2017)8 le 14 juin 2017.
