Finland ratified the Revised European Social Charter on 21/06/2002, accepting 88 of the 98 paragraphs of the Revised Charter.

It ratified the Additional Protocol providing for a system of Collective Complaints on 17/07/1998. Finland has made a declaration enabling national NGOs to submit collective complaints.

Finland ratified the European Social Charter and the Additional Protocol to the Charter on 29/04/1991. It ratified the Amending Protocol to the Charter on 18/08/1994.

Finland ratified the Additional Protocol providing for a system of Collective Complaints on 17/07/1998. It has made a declaration enabling national NGOs to submit collective complaints.

Retour N° 106/2014 Finnish Society of Social Rights c. Finlande

La réclamation, enregistrée le 29 avril 2014, porte sur l'article 24 (droit à la protection en cas de licenciement) de la Charte sociale européenne révisée. L’organisation réclamante allègue que, en cas de licenciement illégal, la loi ne prévoit pas de possibilité de réintégration et impose que l’indemnité de licenciement soit plafonnée, en violation de la disposition susmentionnée.

Le Comité européen des Droits sociaux a adopté sa décision sur la recevabilité et le bien-fondé le 8 septembre 2016,

Dans sa décision sur la recevabilité et le bien-fondé, le Comité :

  • à l’unanimité déclare la réclamation recevable ;

et conclut :

  • par 7 voix contre 4, qu’il y a violation de l’article 24 de la Charte sur la question de l'indemnisation ;
  • à l’unanimité, qu’il y a violation de l’article 24 de la Charte sur la question de la réintégration.
