Terms of reference of the Steering Committee on Media and information Society (CDMSI)

Background

Comments by CDMC members were taken into account in the finalisation of the draft terms of reference. The draft term of reference was examined by the Group of rapporteurs on Human Rights (GR-H) which required amendments on the basis of comments and drafting proposals by member states. The Secretariat will inform the CDMC of the state of play.

Background

The draft has been the subject of several rounds of consultations, including more recently, during a meeting Brussels on 12-13 September 2011. It was finalised by the MC-NM at its meeting on 20 and 21 September 2011.

Background

Background

Following decision at 14th CDMC meeting, a draft was kindly prepared by Els Hendrix (Germany). It was discussed and amended by the Bureau.

Draft Recommendation on gender aspects of Council of Europe Recommendations and Declarations including addenda to Declarations and Recommendations

Background

Following the CDMC decision to gender proof a number of CoE CM Recommendations and Declarations a draft has been prepared. The Bureau discussed the draft and agreed to send written drafting proposal by 30 October. The draft will then be amended accordingly.

Draft Declaration on the sustainability of EuroDIG

Background

The Bureau discussed the sustainability of EuroDIG. In particular, it envisaged the possibility of a Committee of Ministers declaration on support to be given to it as the European IGF. It was agreed that a draft should be prepared and submitted to the CDMC at its 15th meeting. Maja Rakovic kindly agreed to prepare a draft.

Background

Draft Declaration on public service media governance

Draft Recommendation of the Committee of Ministers to the member states on Public Service Media Governance

The Draft recommendation on public service media governance will be on the agenda of the Committee of Ministers for its meeting of December (probably 7/12). After several consultations and electronic discussions, the draft was approved by e-mail by the CDMC. Following the Council of Europe legal advice’s suggestion, the Bureau decided that the text be split into a draft declaration and a draft recommendation without changes to the substance. The drafts will therefore be submitted to the Committee of Ministers for adoption.

Take note of the state of play regarding the texts.

Wolfgang Kleinwächter, Chairperson of the MC-S-CI will report on the meeting and hold an exchange with the CDMC of possible follow up action in respect of instruments recently adopted by the CM.

    Ad hoc Advisory Group on Public Service Media Governance (MC-S-PG)

Note

At its 14th meeting, the CDMC agreed that the MC-S-PG had completed its work and should therefore be discontinued.

    Ad hoc Advisory Group on the Protection of Neighbouring Rights of Broadcasting Organisations (MC-S-NR)

Note

The meetings of the MC-S-NR have been postponed in the absence of a negotiating mandate for the European Commission. The Secretariat will inform on the state of play, including in the framework of WIPO.

7. Discussion on the future work programme of the Steering Committee on Media and Information Society (CDMSI)

Background

Once the terms of reference for the CDMSI have been adopted, the Secretariat will prepare work-plans for the various expected results. The CDMC’s guidance is welcome in this connection. Brainstorming and mapping out meeting may be organised in respect of certain subjects.

Expected action

The CDMC should discuss the matter and give guidance to the Secretariat.

8. Stocktaking of CDMC work

Background

At its 14th meeting, the CDMC asked the Secretariat to prepare a draft stocktaking document of its work since 2005 for consideration at its next meeting.

Background

The CDMC decided that reflection should start on the themes and content of the conference in light of its preliminary discussions. Two experts were invited to prepare discussion papers and hold an exchange with the CDMC, namely Messrs Ziga Türk and Ren Reynolds. Only Ren Reynolds was available for the meeting.

Expected action

Discuss this matter and hold an exchange of views with the expert.

The Bureau took note of the information and of the above mentioned motion that was introduced at the last session of the Parliamentary Assembly but not discussed.

Report on Fight against terrorism, presented during the last session of the Parliamentary Assembly.

Note

The Chairperson of the Bureau mentioned that report and regretted that, although it mentions the need for a revision of anti-terrorism legislations, it makes no reference to the Reykjavik resolution on the subject.

Note

The Bureau discussed the EC’s project. It decided to ask the Council of Europe Secretary general to write to EC Commissioner Neelie Kroes on the subject, welcoming the initiative, recalling CoE work and offering to build synergies between both organisations. It also decided that the Chair of the CDMC will also contact the group's chairperson (former President of Latvia, Professor Vaira Vīķe-Freiberga) in similar terms.
