STEERING COMMITTEE ON
During its 7th meeting, the CDMC:
- pursued its discussion on a possible future mechanism for promoting respect of Article 10 of the European Convention on Human Rights, without reaching a conclusion; it asked the Committee of Ministers for further instructions on the subject;
- approved human rights guidelines for internet service providers and for online games providers, prepared by its subordinate Group of specialists on human rights in the Information Society (MC-S-IS) in cooperation with relevant industry representatives;
- reviewed progress in the work of its subordinate bodies and took decisions on future work in respect of a possible convention on the protection of the neighbouring rights of broadcasting organisations and in respect of media complaints bodies;
- encouraged the secretariat to organise a conference to explore with media professionals the impact that developments in national legislation since 2001 concerning the fight against terrorism has had in practice on freedom of expression and information and freedom of the media;
- made progress in the preparation of the First Council of Europe Conference of Specialised Ministers responsible for Media and New Communication Services (to be held in Reykjavik, on 28 and 29 May 2009), as regards the programme and elements for an action plan;
- discussed the Council of Europe’s participation in and contribution to the UN-led Internet Governance Forum (IGF) and the World Summit on the Information Society action lines and encouraged the Secretariat to organise a European preparatory meeting in anticipation of the December 2008 IGF;
- decided in favour of a request by the non-governmental organisation Association of European Journalist (AEJ) for observer status with the CDMC;
- held an exchange of views with Mr Miklos Haraszti, OSCE Representative on Freedom of the Media;
Items 1 and 2. Opening of the meeting and adoption of the agenda
1. The Steering Committee on the Media and New Communication Services (CDMC) held its 7th meeting from 27 to 30 May 2008 at the Palace of Justice (Justizpalast) in Vienna at the invitation of the Austrian authorities. Participants were welcomed by Dr Wolfgang Pöschl, Vice-president of the High Court of Austria and, in a separate event at the Chancellery, by Mr Manfred Matzaka, Director General of Federal Chancellery.
2. The meeting was chaired by Mr Matthias Traimer (Austria). The Chairperson welcomed, in particular, those participants attending a CDMC meeting for the first time. The list of participants is set out in Appendix I. The CDMC adopted the agenda, as set out in Appendix II, and the order of business (document CDMC(2008)OT1) subject to certain changes..
Item 3. Decisions of the Committee of Ministers of interest to the work of the CDMC
3. The CDMC noted the adoption by the Committee of Ministers on 20 February 2008 of the Declaration on the management of the digital dividend and the public interest and the Declaration on protecting the dignity, security and privacy of children on the Internet and, on 26 March 2008, of the Recommendation on measures to promote the respect for freedom of expression and information with regard to Internet filters and the Declaration on the independence and functions of regulatory authorities for the broadcasting sector.
4. Certain delegations welcomed, in particular, the timely adoption of the Declaration on the management of the digital dividend and the public interest in view of current discussions on the subject, e.g. within European Union bodies. There was general agreement as to the desirability to bring the Council of Europe point of view on the matter to appropriate fora.
5. The Steering Committee also noted with satisfaction that, following its request, the Committee of Ministers gave it ad hoc terms of reference “To resume examination of the protection of the neighbouring rights of broadcasting organisations, by, in the first place, taking stock of the situation and, if justified, elaborating a draft Council of Europe binding instrument designed to reinforce the protection of the neighbouring rights of broadcasting organisations.” These terms of reference expire on 31 December 2009. The CDMC welcomed a voluntary contribution made by Finland to help finance this work. As regards further steps to be taken, see item 10.
6. The Steering Committee took note of the adoption by the Committee of Ministers of the White Paper on Intercultural Dialogue (see also paragraphs 23) and of the Communiqué on the 118th Session of the Committee of Ministers.
Item 4. Request for observer status by the non-governmental organisation Association of European Journalists with the CDMC
7. The CDMC held an exchange of views with the Association of European Journalists (AEJ) Representative on Freedom of the Media and Chairman of the AEJ UK Section, Mr William Horsley, on AEJ’s request for observer status with the Steering Committee. The CDMC decided in favour of this request; the situation will be reviewed when considering future terms of reference for the CDMC.
8. In this context, the CDMC discussed AEJ’s representativeness and their capacity to effectively contribute to CDMC work, including during meetings. It noted with interest recent documents produced by AEJ on the media in certain countries. Some participants signalled the differences between the AEJ and the European Federation of Journalists (EFJ), underlining the valuable contribution which the latter organisation makes to CDMC work.
9. The CDMC observed that consideration will have to be given soon to its future working structures / groups of specialists and to observers thereto. This will be the occasion to consider whether AEJ should be offered observer status with any of them.
10. Certain CDMC delegations also recalled that Mr Horsley animated very successfully a broadcasted debate on the margins of the last specialised Ministerial Conference (Kyiv, March 2005); it was suggested that this be taken into account in the preparation of the coming Conference of Ministers in Reykjavik.
Item 5. Work programme for the CDMC in 2008
11. The CDMC agreed to the approach favoured by the Bureau in respect of action to implement the ad hoc terms of reference given to the Steering Committee by the Committee of Ministers on 13 June 2007 “to examine and make recommendations on the operation and functioning of media complaints procedures and media complaints bodies established in member states, taking into account any difficulties faced by individuals and groups affected by statements in the media to obtain redress through these mechanisms”(see paragraphs 8 to 9 of the report on the last meeting of the Bureau).
12. An expert round-table should therefore be organised with representatives of media complaints bodies, professional associations and other relevant actors to explore the issue in further depth. If possible, it could take place in June 2008 or back-to-back to the next Bureau meeting (16 and 17 October 2008). In order to contribute to the experts’ discussions, the Bureau suggested that, resources permitting, a consultant be asked to prepare an analysis of mechanisms already in place. The CDMC noted with interest information received from Mr Aidan White, Secretary General of the International Federation of Journalists (IFJ), on the development by a multinational media group of company-wide code of professional conduct and model contract for journalists employed by the group.
13. Further, the CDMC pursued its discussions on its work programme in 2008, particularly in the light of the work envisaged by its groups of specialists and the preparation of the next Council of Europe Conference of specialised ministers (to be held in Reykjavik on 28 and 29 May 2009). The Secretariat recalled the request by the Committee of Ministers for a report on the implementation of the Warsaw Action Plan and hence the Kiev Action Plan insofar as the CDMC is concerned for the Ministerial session of the Committee of Ministers in May 2009.
Item 6. Promoting visibility of the work of the CDMC
14. The CDMC pursued its discussions on this subject. It took note, in particular, of a flyer prepared by the Secretariat to inform various publics on the work done by the CDMC and by the Media and Information Society Division. Its simple form will enable frequent and inexpensive updating. The document is being widely disseminated and is available on electronic form for use, for example, by CDMC members.
15. The CDMC also noted the answers received so far to a questionnaire on the visibility provided by CDMC members themselves to Council of Europe freedom of expression and media-related standards. Delegations that haven’t sent their reply yet were urged to do so, in order for the Secretariat to be able to prepare a synthesis for the October meeting of the Bureau.
Item 7. Draft instruments or texts submitted for consideration by the CDMC
- Guidelines to assist Internet Service Providers in their practical understanding of, and compliance with, key human rights and fundamental freedoms in the Information Society, in particular with regard to Article 10 of the European Convention on Human Right
16 The CDMC approved the guidelines, subject to certain amendments worked out in the course of an exchange of views with Mr Kurt Einzinger, chairperson of the European Internet Service Providers Association (EuroISPA).
- Guidelines to assist online games providers in their practical understanding of, and compliance with, human rights and fundamental freedoms in the Information Society, in particular with regard to Article 10 of the European Convention on Human Rights
17. The CDMC approved the guidelines, subject to certain amendments worked out in the course of an exchange of views with Mr Patrice Chazerand, Secretary General of the Interactive Software Federation of Europe (ISFE).
18. The CDMC commended the approach followed in respect of the elaboration by the MC-S-IS of the above-mentioned two instruments, namely constructive inter-governmental co-operation with industry. It invited the two industry organisations to make every effort to disseminate the respective guidelines to their members and to participate in the promotion of human rights and other relevant Council of Europe standards in their activities.
Item 8. Implementation of Council of Europe standards on media and freedom of expression
19. The CDMC pursued its discussions on this subject and took note of the updated version of document CDMC(2006)006rev (updating of which will be completed for the next October meeting of the Bureau) (see also item 6 above). It concluded that, having regard to the upcoming Ministerial Conference, it is not necessary to launch further implementation monitoring exercises but that those already underway should be completed.
20. The CDMC also agreed that it would be desirable for groups of specialists and, when appropriate, the Steering Committee itself to provide an indication of concrete proposed follow-up to instruments submitted for adoption (e.g. means to assess implementation or impact and further action to be taken following such assessment). The CDMC also discussed the desirability of Ministers who will participate in the Reykjavik Ministerial Conference expressing in clear terms their commitment to implementing relevant Council of Europe standards; this could be done in a specific resolution also addressing the means of rendering such standards effective in practice.
Item 9. Discussion on a possible future mechanism in respect of Article 10 of the European Convention on Human Rights
21. The CDMC pursued its discussion on this subject in light, inter alia, on the basis of a Bureau report on the state of discussions (document CDMC-BU(2008)002rev). It decided to ask the Committee of Ministers for further instructions on the subject.
22. While recognising that problems exist as regards respect for Article 10 of the Convention in member states, an indicative tour de table during which 30 CDMC delegations took the floor, showed a majority of 14 to 12 against the establishment of a new monitoring mechanism.
23. The two observers that expressed a view on this subject during the meeting, and the OSCE Representative on Freedom of the Media (see paragraph 42), expressed their support for a Council of Europe mechanism designed to strengthen respect for Article 10 of the European Convention on Human Rights and freedom of the media in member states.
Item 10. Discussion on a possible Council of Europe convention on the protection of the neighbouring rights of broadcasting organisations
24. . The CDMC thanked Ms Delia Mucica for her report on the state of play of the project and further steps envisaged. It noted that a first stock-taking meeting will take place in the coming weeks with delegations that have indicated their readiness to contribute to this work without expecting reimbursement from the Council of Europe for the expenses incurred (namely Armenia, Austria, Finland, the Netherlands, Romania, Switzerland, the United Kingdom, EBU and ACT).
25. The CDMC agreed to the procedure proposed; it requested that the Bureau and then the CDMC be informed of the results at their next meetings, respectively in October and November 2008. One delegation expressed the desirability that this matter be dealt with rapidly and, in consequence, that the group makes a start on elaborating a text during this period.
Item 11. Ongoing work of the CDMC’s subordinate bodies
- Group of specialists on human rights in the Information Society (MC-S-IS)
26. The CDMC took note of the report of the 9th meeting of the MC-S-IS and held an exchange of views with Mr Thomas Schneider, Chairperson of the group, on progress being made by the MC-S-IS towards fulfilling its terms of reference (cf. also item 7 above). In particular, reference was made a possible standard-setting instrument on a “trustmark” for Internet services and safe surfing for children. This proposal was received positively by participants. The CDMC encouraged closer cooperation with the Council of Europe services dealing with children and youth.
- Group of specialists on media diversity (MC-S-MD)
27. The CDMC took note of the report of the 7th meeting of the MC-S-MD and on progress being made by the MC-S-MD towards fulfilling its terms of reference.
- Group of specialists on public service media in the Information Society (MC-S-PSM)
28. The CDMC took note of the report of the 7th meeting of the MC-S-PSM and held an exchange of views with Mr Patrick Segalla, Chairperson of the group, on progress being made by the MC-S-PSM towards fulfilling its terms of reference.
29. The CDMC stressed the importance of pursuing this area of activities after the Reykjavik Ministerial Conference.
- Living together
30. The CDMC held an exchange of views with Ms Bissera Zankova, coordinating the “Living Together” project on behalf of the CDMC. She detailed the format of the future output of the project (a guidebook with examples of best practice) and underlined its cross-cutting nature. It is foreseen that the text will be ready for publication in January 2009 and available for the Conference of specialised ministers in Reykjavik. Ms Zankova called for contributions from CDMC delegations which might be integrated into this work. The CDMC confirmed its support for this work.
Item 12. Work on media in times of crisis and on intercultural dialogue
31. The CDMC held an exchange of views with Ms Bissera Zankova, coordinating freedom of expression in times of crisis work on behalf of the CDMC. Ms Zankova provided an update on progress being made and expected results.
32. The CDMC welcomed, in particular, the operation of the new Council of Europe web-based forum where media professionals and other interested parties can discuss the rights and responsibilities of the media and the working conditions of journalists in times of crisis. In the Steering Committee’s view, this discussion space could also be used to exchange information and coordinate media’s initiatives relating to intercultural and inter-religious dialogue.
33. On related subjects, the CDMC also welcomed work being carried out by other Council of Europe services (implementation of the White Paper on Intercultural Dialogue) to encourage the media’s contribution to intercultural and inter-religious dialogue; this provides a satisfactory reply to action proposed in the Kyiv Action Plan to that effect. The CDMC also noted that, in the view of the Council of Europe Secretariat, this work may clarify, in due course, the way forward in respect of the creation of an award for media which have made an outstanding contribution to conflict prevention or resolution, understanding and dialogue.
34. Concerning a thematic study examining developments in national legislation since 2001 concerning the fight against terrorism which have a bearing on freedom of expression and information and freedom of the media, the CDMC approved the proposed method and time frame (i.e. completion of the study by mid-September 2008, submission to the Bureau in October and to the CDMC in November). It also decided that, resources permitting, a conference be organised to explore with media professionals the impact of the legal developments in practice. This will permit to identify further action required.
35. Regarding other questions submitted for consideration at the meeting, the CDMC confirmed its decision not to pursue the MC-S-IC proposal of a Council of Europe coordinator for media in times of crisis. It also decided not to pursue further the proposal concerning the training of media professionals covering crisis situations.
Item 13. Internet governance and implementation of WSIS action lines
36. The CDMC took note of the information provided by the Secretariat on these subjects. It also noted the information on the next Internet Governance Forum (Hyderabad, India, 3 to 6 December 2008), its programme (with main sessions on: reaching the next billion: access / multilingualism; promoting cyber-security and trust: are we losing the battle against cybercrime / fostering security, privacy and openness; managing critical internet resources: transition from IPv4 to IPv6 / arrangements for internet governance – global and national / regional; and emerging issues: the internet of tomorrow – the innovation and evolution of the internet) and the proposed contribution by and participation of the Council of Europe.
37. The Steering Committee encouraged the Secretariat to organise a European preparatory meeting in anticipation of the December 2008 IGF, as suggested by some member states. In this context, some members evoked the need for a regional approach to discussions on Internet governance. The desirability of integrating a multi-stakeholder approach to related CDMC work was also emphasised.
Item 14. First Council of Europe Conference of Ministers responsible for the Media and New Communication Services (Reykjavik, 28-29 May 2009)
38. The CDMC pursued discussions on a draft programme, possible key note speakers, moderators and panellists. It also started considering items for the elaboration of texts, in particular a draft action plan, for possible adoption at the Conference. The Conference will focus on a new notion of media and the resulting standard-setting requirements, consolidation/effectiveness of media-related Council of Europe standards and on the Council of Europe’s vision of Internet governance.
39. As regards the elaboration of texts, the Steering Committee on the whole agreed with the elements contained in a preliminary text prepared in light of comments provided by various delegations, the groups of specialists and the Bureau. There was consensus that there should be internal coherence in the texts to be adopted and that the action plan should be short and provide a general framework for future work, rather than a detailed comprehensive list of items. The Secretariat was asked to amend the outline programme in light of the texts under consideration.
40. In addition, certain delegations requested to consider additional elements, such as the role of regulatory authorities in the context of convergence and the question of the protection of personal data. As regards the latter, the CDMC noted that a major conference is being organised by the Council of Europe in October 2008; it agreed that the Reykjavik action plan should take account of ongoing work on the subject and of the outcome of that conference.
41. Certain participants also suggested that a new notion of media might have an impact on the ongoing revision of the European Convention on Transfrontier Television. This idea was supported by certain delegations that are confronted with this matter in the context of the transposition into national legislation of the Audiovisual Media Services Directive.
42. At the invitation of the Chairperson, certain delegations expressed an interest to elaborate on specific topics to be considered at the Ministerial Conference, as follows: Germany (media and the delivery of public service), Cyprus, Denmark and Iceland (public service media’s outreach to young audiences), Montenegro (regulatory authorities and convergence), Austria (users’ empowerment and literacy), Romania (user-generated content, including from authors rights’ perspective). For its part, ENPA offered to elaborate on the effectiveness of Council of Europe standards (in particular as regards the protection of journalists).
43. Other written contributions will be welcomed, as will the undertaking of delegations to prepare more elaborate written submissions for the Ministerial Conference proper in respect of specific sub-themes of the programme.
44. The CDMC also started considering possible keynote speakers, moderators and panellists on the basis of suggestions made by Bureau and CDMC members. The Steering Committee welcomed the suggestions and asked those making them to seek to contact the persons concerned in order to establish their a priori interest and availability. Other suggestions should be sent to the Secretariat at the earliest opportunity. In this context, attention should be paid to the sub-themes of the Conference, as well as to language competencies and gender balance.
45. Ms Elfa Gylfadottir (Iceland) indicated that the host Minister might send already during the Autumn 2008 a letter to her counterparts in member states informing them of and inviting them to the upcoming Ministerial Conference. This may be the occasion to gather information on Ministers who intend to take part in the Conference and interest to contribute to specific themes or roundtable discussions; this information will be supplemented in due course with an electronic registration form and database of likely participants.
46. Ms Gylfadottir confirmed that arrangements are being made for a one-day CDMC meeting to be held on the eve of the Ministerial Conference in Reykjavik. The Secretariat recalled that, in respect of the Steering Committee meeting preceding the last Ministerial Conference (Kyiv), CDMC members only received one-day subsistence allowance, but were not reimbursed for travel.
47. On behalf of the Conference of INGOs, Mr Gabriel Nissim indicated that an INGO Forum would not be organised in Reykjavik because of financial constraints and given that there would be ample time for civil society to hold meetings elsewhere (in Brussels and Strasbourg) with a view to working out their proposals to Ministers well before the Conference.
48. On the other hand, it is still possible to organise a Youth Forum on 25 and 26 May 2009, enabling youth organisations to make their views known on matters to be discussed by Ministers. Ms Gylfadottir asked the Secretariat to confirm with the relevant Council of Europe department that this option should be retained.
Item 15. Standing Committee on Transfrontier Television (T-TT)
50. The CDMC took note of the information provided by the secretariat on on-going work on the revision of the European Convention on Transfrontier Television [CETS No.: 132]. It is expected that a draft will be ready for the T-TT to examine during its November 2008 meeting.
Item 16. Information on the work of, and co-operation with, other Council of Europe bodies, of interest to the CDMC
51. The CDMC took note of the information on the work of relevant Council of Europe bodies - Ad hoc Committee on e-democracy (CAHDE), Committee of experts for the development of human rights (DH-DEV), Group of experts on access to official documents (DH-S-AC), European Co-ordination Forum for the Council of Europe Disability Action Plan 2006-2015 (CAHPAH), - provided in particular by Bureau and other Steering Committee members having represented the CDMC at their meetings.
52. It welcomed CDMC participation in the meetings of those bodies and noted their relevance to the Steering Committee’s own work. However, it also observed that the number of requests for CDMC participation in those meetings and other events is increasing. The CDMC decided that, resources permitting, a favourable response should be given to relevant invitations and discussed ways of rationalising participation (early information on upcoming meetings/events, elaboration of a list of CDMC members available to attend such meetings/events). CDMC members available to take part in such meetings or events were invited to send to the Secretariat a résumé of their professional activities and areas of interest/expertise.
Item 17. Other information of interest to the work of the CDMC
53. The CDMC took note of the information provided orally by Mr Skender Adem (Slovenia) of the on-going and future activities related to media and information society of the Slovenian Presidency of the European Union.
54. The Secretariat also informed the CDMC of the work in progress in respect of the European Convention on the Legal Protection of Services based on, or consisting of, Conditional Access, and recalled that a questionnaire has been sent to members in order to facilitate the analysis undertaken.
Item 18. Administrative and budgetary matters
55. The CDMC took note of the information provided by the Secretariat on relevant issues and developments relating to administrative and budgetary matters.
56. In particular, as a consequence of last year’s reorganisation within the Council of Europe which led to the creation of the Directorate General of Human Resources and Legal Affairs and due to the latter’s internal organisation, the technical assistance activities related to media issues previously carried out by the Media and Information Society Division have now been entrusted to the Directorate of Cooperation.
Item 19. Dates of next meetings
57. The CDMC noted that its 8th meeting is scheduled for 25 to 28 November 2008. It also took note of the dates of meetings of the CDMC’s subordinate bodies and of the T-TT as set out in document CDMC(2008)003.
Item 20. Items to be included on the agenda of the 8th meeting of the CDMC
58. The CDMC approved the preliminary list of items to be included in the agenda for its 8th meeting (CDMC(2008)OJ2Prov). At the proposal of Ms Elfa Gylfadottir (Iceland), a suggestion that was supported by Norway, the CDMC decided to include the question of betting and gambling advertising on the Internet. The Icelandic and Norwegian CDMC members will submit a background document on the subject for consideration at the next Bureau meeting.
Item 21. Other business
59. The CDMC held an exchange of views with Mr Miklos Haraszti, OSCE Representative on Freedom of the Media. Mr Haraszti reiterated his call for decriminalisation, or at least “deprisonisation”, of defamation in Council of Europe member states, including those countries which do not use existing criminal law provisions to retribute journalists’ professional conduct or mistakes. The OSCE Representative on Freedom of the Media also expressed support for the establishment of a specialised Council of Europe monitoring mechanism capable of contributing to the effectiveness in practice of the organisation’s valuable minimum standards on media and freedom of expression.
Item 22. Abridged report
60. The CDMC examined and adopted the abridged report of its 7th meeting, subject to some changes. The full meeting report will be prepared within the coming weeks and circulated to CDMC members for comments and adoption by e-mail exchange.
