The action “Strengthening the Human Rights Protection in the Context of Migration in Türkiye” aims at supporting the Turkish authorities in enhancing detention conditions and ensuring that appropriate procedural safeguards are in place in line with European and international standards in the context of migration. The action is implemented under the joint European Union and Council of Europe programme “Horizontal Facility for the Western Balkans and Türkiye” (Horizontal Facility III).

A new joint publication from the Council of Europe and the European Union Agency for Fundamental Rights (FRA) outlines the relevant human rights standards at Europe’s borders that apply to children.

The note on ‘Children in migration: Fundamental rights at European borders’ summarises the main safeguards of European law as they apply to migrant children at the external borders of the EU and of the Council of Europe. It covers the European Convention on Human Rights (ECHR) and EU law.

The publication builds on the previous joint notes: Fundamental rights of refugees, asylum applicants and migrants at the European borders (March 2020); and European standards on legal remedies, complaints mechanisms and effective investigations at borders (July 2021).

The Council of Europe Committee of Ministers adopted Recommendation on human rights principles and guidelines on age assessment in the context of migration and its Explanatory Memorandum on 14 December 2022.  The Recommendation is the first international legal instrument setting human rights standards on age assessment in the context of migration.

The Consultation Group on the Children of Ukraine (CGU): Established in November 2023, the CGU was created as an emergency response to Russia’s war of aggression against Ukraine, following a call from the Heads of State and Government of the Council of Europe member states during the Reykjavík Summit. Its core mission is to strengthen the protection of children of Ukraine affected by the war and particularly those who have fled to member states, through dialogue and practical support.

A new joint note Children in migration: fundamental rights at European borders by the Council of Europe and the FRA outlines the relevant human rights standards at Europe’s borders that apply to children.

In the context of the Action Plan on migrant children on 3 March 2017, the Lanzarote Committee adopted the Special report Protecting children affected by the refugee crisis from sexual exploitation and sexual abuse, as an outcome of an urgent monitoring round it launched to assess how Parties to the Lanzarote Convention were protecting children affected by the refugee crisis from sexual exploitation and sexual abuse.

As a follow-up to this report, the current Action Plan invites the Lanzarote Committee to promote good practices in the implementation of the recommendations of the special report, with a focus on aspects of missing children and preventive measures. To this end, the Lanzarote Committee already adopted, on March 2022, compliance reports concerning the 10 recommendations. 

Compliance reports

On 5 July 2022, a Checklist was prepared by the Lanzarote Committee’s secretariat on the basis of the Committee’s urgent monitoring findings on “Protecting children affected by the refugee crisis from sexual exploitation and sexual abuse”. This Checklist provides concrete guidance for migration practitioners and policy makers to swiftly identify appropriate measures to take and procedures to follow to prevent and protect children affected by refugee crisis from sexual abuse. It is a practical tool to support the authorities confronted by the arrival of children, in particular those fleeing Ukraine.

The Checlist was made available in Ukrainian, Hungarian, Polish, Slovak, Czech and Romanian (in addition to English and French). This Checklist provides concrete guidance for migration practitioners and policy makers to swiftly identify appropriate measures to take or procedures to follow to prevent and protect children affected by refugee crisis from sexual abuse. The Council of Europe has launched a Handbook on how to better protect children against sexual exploitation and abuse in crisis and emergency situations

A round table, entitled: Strengthening the protection of children and victims of gender-based violence, in the context of refugee flows in Romania was co-organised by the Council of Europe and the UNHCR in Bucharest on 22 November 2023

Other major achievements of the Lanzarote Committee related to the Action Plan include

• 3rd monitoring round on sexual abuse in the circle of trust,
• Factsheets to highlight and facilitate the implementation of the Committee’s monitoring findings to help parties address the challenges raised by child self-generated sexual images and/or videos,
• The decision in September 2023 to address urgent questions to the Russian Federation on the situation of Ukrainian children unlawfully transferred or deported to its territory or areas temporarily controlled/occupied by it ;
• The adoption in February 2024 of a survey to gather information about data collection mechanisms on child sexual exploitation and sexual abuse.

The department on execution of judgments will organise an exchange of good practices on implementing at national level the Court judgments concerning vulnerability of accompanied and non-accompanied minors and access to asylum.

On 20 May 2022, in Turin, Italy, the Committee of Ministers adopted a new recommendation to protect the rights of migrant, refugee and asylum-seeking women and girls providing measures to better respond to needs and challenges that they face.

• Co-operation projects run by Gender Equality Division in Armenia, Ukraine and the Republic of Moldova focus on combating violence against women, include components working on the needs of asylum-seeking and refugee women and girls. The project “Ending violence against women and promoting gender equality in Armenia” in January 2024 incorporated a new component to assist Armenian authorities in enhancing strategies and policies addressing the needs of refugee women and girls, raising awareness, and supporting their integration and empowerment.

The Guide was presented to the National Preventive Mechanisms (NPMs) during a workshop of the European NPM Forum in June 2024. The Guide is to be supplemented by an additional checklist for the NPMs, similar to the existing checklists for lawyers and medical practitioners.

• In the framework of the action on “Strengthening the Human Rights Protection in the Context of Migration in Türkiye”, over 200 lawyers from eight local bar associations across Türkiye gained expertise in European and international human rights standards, focusing on immigration detention and procedural safeguards, through a series of cascade training sessions in 2024.

> On 15 June 2022, the Committee of Ministers adopted an Explanatory Memorandum to the Recommendation CM/Rec(2019)11 of the Committee of Ministers to member States on effective guardianship for unaccompanied and separated children in the context of migration.

> The Committee for the Rights of the Child (CDENF) finalised the implementation review of the Recommendation CM/Rec(2019)11 on effective guardianship for unaccompanied and separated children in the context of migration and published the report . Adopted at the CDENF plenary meeting in December 2024, the report is based on the replies to a questionnaire by member states and includes references to consultations with children and young people who have experienced the guardianship system. A full report on these consultations is appended to the implementation review report.

Türkiye

> Evaluation Report on the Guardianship System for Children in the Context of Migration in Türkiye analysing the country’s guardianship system and proposing 11 recommendations for improvement.

The Steering Committee for Human Rights in the fields of Biomedicine and Health (CDBIO) is developing measures, promoting fair access to healthcare for vulnerable groups, including refugees and migrants, especially in the context of pandemics. They include a guide to health literacy, and standards on equitable access to medical treatment and equipment and to innovative treatments.

On 9 November 2021, the Council of Europe’s Department for the Execution of Judgments of the European Court of Human Rights published a new thematic factsheet on cases related to migration and asylum.

The factsheet summarises measures reported by 23 member states to protect and further strengthen migration- and asylum-related rights in response to 66 different judgments from the ECHR. It covers topics including access to territory and forced returns, the reception and protection of migrants and asylum seekers, protection from discrimination and hate crime, family life and family reunification and the detention of migrants and asylum seekers.

On 2 February 2022, the Council of Europe Committee of Ministers took note of the Guide on family-based care for unaccompanied and separated children developed by the Steering Committee for Human Rights.

The guide highlights key aspects for Council of Europe member States to consider when developing and implementing family-based care for unaccompanied and separated children in the context of migration.

Hold thematic discussions on child-friendly approaches and procedures in migration within the Network of Focal Points on Migration and with other stakeholders (including in follow-up to Recommendation CM/Rec(2019)11 on effective guardianship).

The Network of Focal Points on Migration held its first thematic discussion on child-friendly approaches and procedures in migration during its 5th meeting on 9-10 June 2022. 

Identify and promote good practices in respect of legal aid and representation, and access to information and justice for vulnerable people in the context of asylum and migration, and develop related guidelines  or policy recommendations.

An International Conference and technical meeting of experts, co-organised by CDCJ and the UNHCR,  took place on 23-24 September 2021, on "Statelessness and the right to a nationality in Europe: progress, challenges and opportunities".

Priority follow-up actions to be undertaken in the period 2022-2025 to pursue the work on statelessness include the elaboration of guidance on child-sensitive procedures for stateless children and on the establishment of nationality, in particular for children.

Foster international co-operation and investigative strategies in fighting the smuggling of migrants.

• 2nd International Conference on Migrant Smuggling was organised by the Council of Europe in Strasbourg in September 2024 under the auspices of the European Committee on Crime Problems (CDPC) and the SRSG Office, and followed up on the recommendations of 2023 Reykjavik Summit that reaffirmed the necessity to fight against trafficking and smuggling of migrants and committed to intensifying efforts to foster and improve international cooperation in this regard.

The project ended in June 2023, and led to, inter alia, the development of six practical tools for supporting unaccompanied refugee and migrant children in their transition to adulthood (a Compendium of Good Practices, a Roadmap, two videos – one from Greece and one from Spain, a Toolkit, a HELP e-learning course. The tools developed a strong European dimension as part of the project and can be used to strengthen the capacities of different professionals across Europe.

HELP courses in the thematic areas of the Action Plan are available in multiple languages, some in tutored format, and aim at contributing to the enhanced knowledge of legal professionals on key human rights topics and to a better protection of human rights on a national level.

The Asylum/Migration HELP e-Desks facilitate access of legal professionals to  information and training about effective handling of cases at national level related to refugees and displaced persons, with an immediate focus on people from Ukraine.

The Congress of Local and Regional Authorities of the Council of Europe is committed to the full realisation of human rights at local and regional levels as one of its thematic priorities, including for refugees, asylum seekers, migrants and internally displaced persons. Local and  regional authorities are key actors in migration management as they are at the forefront in the provision of services, including healthcare, education and integration, striving to raise citizens’ awareness to create cohesive and inclusive communities.

Multilateral project on Migration - Congress of Local and Regional Authorities

The project "Strengthening resilience in local and regional authorities facing migration challenges" was finalised in December 2024. The project aimed to enhance the capacity of local and regional authorities to manage migration effectively in Poland, the Republic of Moldova and Romania. The project strengthened multi-level dialogue, local institutional capacity, and built resilience on migration management while fostering regional cooperation. Through institutional dialogue, peer-learning, and knowledge-sharing interventions, the project empowered local authorities along with their national associations to better coordinate migration practices, protect human rights, and support migrant integration, particularly with a focus on the most vulnerable groups (women, children, youth and elderly).

13 activities have been organised, altogether gathering 445 participants (268 women and 177 men) from all levels of governments and relevant stakeholders. The established synergies with Ukrainian local authorities provided a better understanding of the context of displacements and gave an impetus to the commitment for continued support for Ukrainian displaced persons. Key achievements include the establishment of the Community of Practice on Migration and Human Rights at the local level (Community of Practice), a multilateral peer-exchange platform that connected over 156 participants (112 women and 44 men) and enabled the exchange of best practices, policy discussions, and facilitated capacity development.

The Community of Practice included representatives from three local authorities per country: Hrubieszów, Rzeszów, and Wrocław (Poland); Edineț, Strășeni, and Vinogradovca (Republic of Moldova); and Bogdan Vodă, Măgurele, and Tulcea (Romania). It also featured representatives from the Association of Polish Cities, the Congress of Local Authorities from Moldova, and the Association of Communes of Romania.

On 6 April 2022,the Council of Europe Committee of Ministers adopted by consensus Recommendation CM/Rec(2022)10 on multilevel policies and governance for intercultural integration. This is the second international standard in this field following the adoption back in 2015 of CM/Rec(2015)1 on intercultural integration, and the first ever co-drafted by representatives of local and national authorities within the framework of the Working Group on Intercultural Integration (GT-ADI-INT).

Set up in 2020 under the Steering Committee on Anti-discrimination, Diversity and Inclusion, the GT-ADI-INT fulfilled its mandate by adapting the Intercultural Cities model to the regional and national level by: 1) reviewing the implementation of CM/Rec(2015)1, in this context, mapping strengths and remaining needs; 2) elaborating a Model Framework for an intercultural integration strategy at the national level, which was adopted by consensus in June 2021; 3) and suggesting ways to promote multilevel governance and policies for intercultural integration.

• Supporting the implementation of this recommendation, the “Capacity building programme and tools for migrant integration” further takes into consideration the tools, practices and achievements of the Intercultural Cities (ICC) Programme, as well as a number of pilot and promising initiatives and projects carried out at national and regional levels. Tailor-made projects to support the implementation of the integration policies were launched in Cyprus in June 2021, Finland and Italy in September 2022 through a joint programme of the European Commission’s Directorate General for Structural Reform Support (DG Reform) and the Council of Europe. The “Manual for the design of a training course on intercultural competence” (2022) to support the design of training courses on intercultural competence targeting staff and officials at all levels of government, thus helping member states to efficiently implement the Council of Europe intercultural integration model.
• The Inclusion and Anti-Discrimination Programmes Division in June 2023 completed a two-year joint project on “Building structures for intercultural integration in Cyprus”, implemented in co-operation with DG REFORM in partnership with the Civil Registry and Migration Department of the Ministry of Interior of the Republic of Cyprus.
• In Finland, a joint project is being implemented on “Building an inclusive integration approach in Finland' in co-operation with the DG REFORM in partnership with the Ministry of Justice of Finland and aims to contribute to the ongoing reform of migrant integration and inclusion in Finland, co-operating with six Finnish municipalities to promote the development and implementation of local intercultural integration strategies and policies through co-ordinated multi-level and multi-stakeholder approaches.
• Furthermore, in 2023 an inter-agency initiative was launched between the Council of Europe, ODIHR, UNHCR and the OECD to offer training courses to Polish city officials, to equip them with the necessary skills and competences related to the welcoming as well as the intercultural integration of migrants and refugees in Poland, in particular of persons fleeing Ukraine. In June 2023, the Intercultural Cities Programme organised the first training course on Intercultural Competences under this initiative, with the support of the SRSG.

Promote the integration of refugees by enhancing their access to education and employement, by facilitating the recognition of their qualifications through the European Qualifications Passport for Refugees and by fostering linguistic integration through education.

The Intercultural Cities Programme issued a policy brief based on research about alternative narratives being developed by cities, big and small, in relation to migration and integration.

The online training programme on alternative narratives and inclusive communication for public authorities was developed in 2021 and is open to the members of the ICC network.

The 14-month follow-up project on enhancing structures and policies for intercultural integration in Cyprus implemented by the Intercultural Cities Programme and DG Reform, in partnership with the Civil Registry and Migration Department of the Ministry of Interior of the Republic of Cyprus, ended in June 2024, and DG Reform granted a follow-up of the project from September 2024.

The Intercultural Cities 18 months pilot programme, the Academy on the Integration of Migrants and Refugees in Polish Cities, came to an end in November 2024. This programme involved cooperation with ODIHR, UNHCR, and OECD.

In Finland, a joint project was under implementation on “Building an inclusive integration approach in Finland' in co-operation with the DG REFORM in partnership with the Ministry of Justice of Finland and aimed to contribute to the ongoing reform of migrant integration and inclusion in Finland, co-operating with six Finnish municipalities to promote the development and implementation of local intercultural integration strategies and policies through co ordinated multi-level and multi-stakeholder approaches.

In Italy, a joint project is being implemented on Reinforcing multi-level policy co-ordination for integration in Italy in co-operation with DG REFORM and in partnership with the Italian Ministry of Labour and Social Policies, aiming to support the Ministry in improving the multi level and multi-stakeholder co-ordination of migrant integration policies.

The Committee of Experts on Intercultural Inclusion (ADI-INT) carried out work on two key deliverables. The first was a guidance document on strategies for inclusion in the fields under the responsibility of the CDADI. Its draft was shared in-house in December 2024 for comments and contributions by interested colleagues. The second is a toolkit on multilevel governance for intercultural integration, which will comprise a self-assessment tool and a depository of good practices and standards to support improvements in areas assessed as weaker (to support MS in the implementation of the Committee of Ministers Recommendation CM (2022)10 on multilevel policies and governance for intercultural integration).

The Network of Focal Points on Migration is composed of members from relevant ministries in the member states dealing with migration issues at national level.

• It exchanges good practices and enhance co-operation between the different stakeholders in the member states and the Council of Europe, including on the implementation at national level the Court judgments concerning vulnerability of accompanied and non-accompanied minors and access to asylum.
• It held its first thematic discussion on child-friendly approaches and procedures in migration during its 5^th meeting on 9-10 June 2022
• It addresses the situation of people fleeing Ukraine, including the need to protect vulnerable persons against abuse, exploitation and trafficking, and in particular unaccompanied children.
