Vulnerability of migrants, asylum seekers and refugees: Council of Europe and European Union standards

The Division on Migration and Refugees (DMR) has published a new thematic paper, entitled: Vulnerability of migrants, asylum seekers and refugees: Council of Europe and European Union standards.

This thematic paper offers a concise overview of the main Council of Europe and European Union legal instruments, as well as relevant case law from the European Court of Human Rights and the  Court of Justice of the European Union, related to vulnerability in migration and asylum. Its purpose is to assist member states in further aligning their laws and practices with European standards in this area.

Published under the Council of Europe Action Plan on Protecting Vulnerable Persons in the Context of Migration and Asylum in Europe (2021–2025), the thematic paper builds on the Action Plan’s four main pillars, which aim to ensure that people with specific needs are properly identified and provided with appropriate protection, support, and information. It highlights the responsibility of national authorities to assess individual circumstances and to ensure that migrants and asylum seekers in vulnerable situations receive the assistance and safeguards required under national and international law.
