On 1-2 July 2026, Petrovac, Montenegro hosted a workshop organised by the CyberSEE joint project of the European Union and the Council of Europe, in co-operation with the Ministry of Justice of Montenegro. Building upon the continuous capacity building efforts and the workshop in October 2025, the event brought together representatives of the Ministry of Justice, Parliament of Montenegro, Prosecution Office, Ministry of Interior, 24/7 Contact Point, Centre for Training in Judiciary and State Prosecution, National Cybersecurity Agency, telecom industry, alongside the European Union Delegation to Montenegro and the Council of Europe.
The workshop focused on strengthening Montenegro’s alignment of national legislation with the Second Additional Protocol (2AP) to the Convention on Cybercrime (Budapest Convention) with particular attention to new co-operation mechanisms for accessing electronic evidence, and practical implementation measures. The participants reviewed the Assessment Report benchmarking national legislation against 2AP, identified priorities for legal reform, and discussed support for the harmonisation of domestic law with its requirements, including preparation of the draft ratification law.
The discussions confirmed that Montenegrin legislation contains some relevant procedural powers however, important gaps remain, particularly regarding direct co-operation with service providers, access to subscriber, traffic, domain name, and stored computer data, as well as emergency disclosure mechanisms.
The workshop highlighted the need for targeted legislative reform, clearer designation of competent authorities and procedures, and practical arrangements for secure electronic co-operation, while noting that Montenegro is comparatively better prepared in areas such as video conferencing and joint investigation teams.
The activity also examined the overall progress in legal reform, capacity building for cybercrime investigations, and inter-agency and international co-operation marking significant advancement in supporting the national authorities.
CyberSEE reaffirmed its commitment to continue supporting Montenegro through technical assistance, capacity building, and legislative guidance, in close co-operation with domestic institutions.
