A request to intervene may be submitted to the Tribunal by: 

  • any person entitled to bring an appeal before the Tribunal under Article 14.10 of the Staff Regulations who establishes a sufficient interest in the resolution of a dispute submitted to the Tribunal;
  • the Staff Committee, where it does not have standing to bring an appeal pursuant to Article 14.10.4 of the Staff Regulations, but where the appeal concerns the interests of the staff as a whole or a category of staff.

 Procedure

  • Application to intervene: the applicant must state the grounds for the request to intervene and submit it to the registry of the Tribunal;
  • Time limit: within 45 days of the publication of the lodging of the appeal; 
  • Observations of the parties: the request is notified by the registry to the parties who may submit their written observations within a time limit established by the Chair; 
  • Decision: the Chair, after consulting the judges of the Tribunal, decides whether to authorise or not the intervention.

 Form and conditions of intervention

In case the intervention is authorised:

  • Intervening party’s access to the file: the Chair decides to which documents in the case file the intervening party has access;
  • Comments of the intervening party: the intervening party may submit - within a time limit fixed by the Chair - written comments limited to supporting the submissions of one of the parties;
  • Language of the intervention: requests for authorisation to intervene, as well as the observations of any third party authorised to intervene, shall be submitted in either of the Tribunal's working languages, regardless of the language of the case;
  • Observations of the parties: the comments from the intervening party are communicated to the parties, who may submit observations within a time limit established by the Chair ; the Chair may decide that the intervening party may comment in reply, within a time limit fixed by him or her; 
  • Oral procedure: an intervening party may not plead in the oral hearing, unless the Chair decides otherwise.
