Back Sweden joins the Budapest Convention and its Additional Protocol

Minister for Foreign Affairs of Sweden, Ann LINDE, today deposited, in the presence of the Council of Europe Secretary General, Marija Pejčinović Burić, the instrument of ratification for :

  • The Convention on Cybercrime (ETS 185), well known as the Budapest Convention
  • The Additional Protocol to the Convention on Cybercrime, concerning the criminalization of acts of a racist and xenophobic nature committed through computer systems (ETS 189)

The Convention on Cybercrime, which was opened for signature in 2001 by Council of Europe member states and non-member states that participated in the drafting of the treaty, is the first and to date the most relevant international treaty on cybercrime and electronic evidence. Its main objective is to pursue a common criminal policy aimed at protecting society against cybercrime, in particular by adopting appropriate legislation and promoting international cooperation.

It has been supplemented by the Additional Protocol to the Convention on Cybercrime, open for signature since 2003, concerning the criminalization of acts of a racist and xenophobic nature committed through computer systems, which broadens the scope of application of the Convention as well as its provisions, in particular by facilitating the use by the parties of means and channels of international co-operation in this field.

A Second Additional Protocol to the Budapest Convention is in the final stages of preparation and is to provide further tools for enhanced cooperation and disclosure of electronic evidence.

With ratification by Sweden, 66 States are now Parties to the Convention and a further 11 have signed it or been invited to accede.
