CyberSEE: Domestic workshops in Bosnia and Herzegovina advance country’s efforts to align the national legislation with the Second Additional Protocol to the Convention on Cybercrime

On 25–26 March 2026, the CyberSEE joint programme of the European Union and the Council of Europe organised a series of back-to-back events in Jahorina, Bosnia and Herzegovina, following the country’s signature of the Second Additional Protocol to the Convention on Cybercrime (Budapest Convention).

These activities built upon the continuous capacity-building efforts undertaken during  March, May, December 2025, and brought together criminal justice authorities across all Bosnia and Herzegovina levels, including the Ministry of Justice, prosecutors, judges, and main interlocutors, alongside the European Union Delegation and Council of Europe experts.

The workshops provided a platform for the National Working Group to go over the legislative review and develop recommendations for further reforms aimed at implementing the Second Additional Protocol (2AP) to the Convention on Cybercrime (Budapest Convention). The discussions focused on changes already implemented, ongoing legal reform initiatives, and remaining gaps in alignment with the provisions of the Convention on Cybercrime, Second Additional Protocol, and other EU instruments like the EU e-Evidence packageNIS2 directive and EU GDPR.

The events highlighted legislative progress and enhanced cooperation on cybercrime and electronic evidence, with participants undertaking a systematic assessment of domestic legislation and engaging in practical discussions on drafting the ratification law, potential reservations, and declarations.

Outcomes included a roadmap with key amendments to the Criminal Procedure Code, and identification of areas requiring further assistance. The resulting report will also facilitate forthcoming European Union–Council of Europe joint interventions from 2027 onwards.

The CyberSEE project reaffirmed its ongoing commitment to supporting Bosnia and Herzegovina through technical assistance, capacity building, and legislative guidance. The project will continue to work closely with domestic institutions to strengthen the criminal justice response to cybercrime and electronic evidence.
