Argentina becomes 35th State to sign the Second Additional Protocol to Convention on Cybercrime

Yesterday, 16 February 2023, Dr Aníbal Domingo Fernández, Minister of Security of the Argentine Republic, signed the Second Additional Protocol to the Convention on Cybercrime, on enhanced co-operation and disclosure of electronic evidence. The event took place in Strasbourg in the presence of Marija Pejcinovic, Secretary General of the Council of Europe. Minister Fernández was accompanied by the  Ambassador of Argentina in France, Mr. Leonardo Daniel Costantino, , and other representatives of the Ministry of Security.

During the exchange with the Secretary General, the Argentinian authorities recognized the highly valuable advantages and tools of this Protocol to combat cybercrime, and underlined their commitment to the Budapest Convention.  They also stated that with the signing of this Protocol, the Argentinian Republic reaffirms one of its main foreign policy objectives, that is, the defense, promotion and protection of the rights of individuals, respect for the principles of international law and the maintenance of international security reinforced by international legal cooperation based on treaties as a tool to fight crime and seek justice.

The Second Additional Protocol on enhanced co-operation and disclosure of electronic evidence was opened for signature on 12 May 2022 within the framework of an international conference in Strasbourg, France. This legal instrument offers innovative tools, such as direct requests to registrars in other jurisdictions to obtain domain name registration information, direct co-operation with service providers in other jurisdictions to obtain subscriber information, more effective means to obtain subscriber information and traffic data through government-to-government co-operation, expeditious co-operation in emergency situations, joint investigation teams and joint investigations, video conferencing, with a strong system of human rights and rule of law safeguards, including for the protection of personal data.
