CyberSEE: Bosnia and Herzegovina continues its efforts towards the signature and implementation of the Second Additional Protocol to the Convention on Cybercrime (Budapest Convention)

On 6 May 2025, the CyberSEE European Union-Council of Europe joint project, in cooperation with the criminal justice authorities of Bosnia and Herzegovina, organised a Domestic Expert Workshop on the Provisions of the Second Additional Protocol to the Convention on Cybercrime in Sarajevo to support the country’s progress towards its signature and implementation.

The event brought together legal drafters, prosecutors, judges, and other key actors from state and entity levels, alongside representatives from the European Union Delegation to Bosnia and Herzegovina, the Council of Europe Office in Sarajevo, and experts from the Council of Europe’s Cybercrime Programme Office (C-PROC).

Building on the high-level meeting held in March 2025, this follow-up workshop focused on the key provisions and benefits of the Protocol, particularly its enhanced cooperation mechanisms for accessing electronic evidence across borders. Experts outlined the legal steps for Bosnia and Herzegovina to sign and implement the Protocol, in line with EU Council Decision 2023/436, and addressed domestic legal challenges in the context of cybercrime investigations.

The workshop enabled a consistent review of relevant legislation across all governmental levels in Bosnia and Herzegovina, discussions of key legal provisions requiring amendments, and the introduction of new legal concepts under the Protocol and focused on identifying key areas where further support from the CyberSEE project may be needed.

The Council of Europe, through the CyberSEE project, continues to assist Bosnia and Herzegovina in progressing towards the signature and implementation of this international instrument, through support for legislative harmonisation and strengthening institutional capacities.
