The activities are organised in the framework of the Project “Strengthening the efficiency and quality of the judicial system in Azerbaijan”, funded by the European Union and the Council of Europe and implemented by the Council of Europe in their Partnership for Good Governance II.

An earlier phase of this programme (January 2015 - December 2017) was supported by the European Union.

Context of the Project

This project is a second phase of cooperation with the Azerbaijani judicial authorities. Between March 2015 and April 2017, authorities from the justice sector of Azerbaijan and CEPEJ co-operated in the framework of the Project “Support to increased efficiency of courts, improved training of judges and judicial self-governance in Azerbaijan”.

 

Project's objective

Court users in Azerbaijan enjoy better access to justice through strengthened efficiency and quality of the judicial system and improved enforcement of court decisions.

 

Expected outcomes

The project has two main domains of action:

  • The enhancement of the efficiency and quality of Azerbaijani courts through the application of CEPEJ tools at national level.
  • The improvement of the enforcement of court decisions through legal and institutional modernisation of the enforcement system.

 

Project beneficiaries and stakeholders

The main beneficiaries and stakeholders of this project in the Republic of Azerbaijan are the Ministry of Justice, the Judicial Legal Council, and the Justice Academy.

Improving the enforcement system in Azerbaijan

On 11 December 2019, three CEPEJ experts held a meeting in Baku with representatives of the Directorate General of Enforcement of the Ministry of Justice (MoJ). The aim of the meeting was to discuss the MOJ study on alternative mechanisms of enforcement of decisions and the entrustment of enforcement to private agencies in Azerbaijan which was launched following the Presidential Decree on “Deepening of reforms in the judicial system” (April 2019). as well as Comments and recommendations provided by the CEPEJ experts to the draft Code of Enforcement of Azerbaijan were also discussed. Mr Mustafayev, Head of the Directorate General of Enforcement of the Ministry of Justice (MoJ) welcomed the contribution of the CEPEJ which will be duly incorporated in the future proposed draft of the Enforcement Code. With respect to the study, the CEPEJ experts provided concrete recommendations according to European standards and practices. They specifically highlighted the need to consider important aspects of private enforcement systems including duties and activities of private enforcement officers, training, the system of fees, liability of enforcement officers, monitoring and control. The CEPEJ will continue to provide its regular support to the MoJ to ensure improvements to the enforcement of court decisions in Azerbaijan.

The activity was organized in the framework of the CEPEJ cooperation project "Strengthening the efficiency and quality of the judicial system in Azerbaijan" under the Partnership for Good Governance II (PGG II), which is funded jointly by the European Union and the Council of Europe and implemented by the Council of Europe.
