The European Committee on Legal Co-operation (CDCJ) held its 99th plenary meeting in Strasbourg and by videoconference from 23 to 25 November 2022. It gathered a total of 90 participants, 49 representing 40 member States and the rest other States, organisations and bodies, including the Council of Bars and Law Societies of Europe (CCBE) and the International Commission of Jurists (ICJ) which were granted observer status at this meeting.
At this meeting, the CDCJ agreed to continue to pay full attention to issues of respect for the Rule of Law and emerging issues in this area and decided to undertake thematic reviews on a regular basis as a follow-up to the Council of Europe Plan of Action on Strengthening Judicial Independence and Impartiality (“Sofia Action Plan”) and its report on the review of the implementation of this Plan of Action . It held an exchange of views on the substantive provisions of a possible draft convention aimed at strengthening the protection of the profession of lawyer and with respect to its implementation mechanism, in order to provide orientations to its subordinate Committee of Experts on the Protection of Lawyers (CJ-AV). The CDCJ also agreed that its subordinate body, the Committee of Experts on the Rights and the Best Interests of the Child in Parental Separation and in Care Proceedings (CJ/ENF-ISE), will continue its work by drawing up two separate recommendations, one relating to parental separation, and one to care proceedings.
The CDCJ examined for the first time the draft guide for practitioners on administrative detention of migrants and asylum-seekers, prepared by its working group, the CDCJ-MIG, and the draft guide for mainstreaming gender in public and private law reform processes, which are expected to be approved in May 2023.
It also approved its comparative study on administrative law and the use of artificial intelligence and other algorithmic systems in administrative decision-making in the member States of the Council of Europe, which will be released shortly, and discussed its future activities with respect to administrative law and artificial intelligence.
