The cooperation mechanism of Convention 108+ at the AFAPDP Meetings

The "Rencontres francophones de la protection des données personnelles", organised by the Association francophone des autorités de protection des données, on 3 October in Tunis, on the occasion of its XIV annual conference, devoted a whole panel to the cooperation mechanisms of the international instruments in force in the field of data protection, the GDPR and, of course, Convention 108+. The need for and the modalities of joint work between States and between supervisory authorities were particularly highlighted and detailed, especially in the context of cross-border flows.

These Meetings were an opportunity to recall that cooperation between government authorities and supervisory authorities can only be mutually beneficial, especially when it comes to updating or revising national instruments on personal data protection. In this respect, compliance with internationally accepted standards is fundamental, and in particular certain principles such as the fact that the processing of data must be proportionate to the legitimate purpose pursued, it must also be lawful, fair and transparent to the persons concerned, and that any exceptions must be provided for by law, respect the essence of fundamental rights and freedoms and be necessary in a democratic society.
