Parental disputes on child relocation – evaluation report

The European Committee on Legal Cooperation (CDCJ) issues a report evaluating the effectiveness of the Committee of Ministers’ Recommendation CM/Rec (2015)4 on preventing and resolving disputes on child relocation.

The report, prepared by Professor Cristina González Beilfuss under the supervision of the CDCJ, reviews the implementation of the Recommendation in Council of Europe member states, including its impact amongst national practitioners; considers the latest findings in legal research and outlines number of recommendations to be further explored to ensure that comprehensive and up-to-date guidance is available to all states and their practitioners on situations concerning the relocation of a child.

As follow-up, the CDCJ agreed to strengthen its efforts for the promotion and awareness raising of the Recommendation and invited its Committee of Experts on the rights and best interests of the child in the context of parental separation and in care proceedings (CJ/ENF-ISE) to consider issues on child relocation in the course of its ongoing work.
