Hearing of the Administrative Tribunal

13.03.2015 - A hearing will be held before the Administrative Tribunal on Tuesday 17 March 2015 in the Tribunal’s hearing-room in the D building at 9.30 a.m. in appeals No. 555 - Geneviève MAYER and No. 556/2014 – Fabrice KELLENS. The hearing will be chaired by Mr Christos ROZAKIS, Chair of the Tribunal.

Registration of two appeals before the Administrative Tribunal

02.02.2015 - On 12 December 2014 and 15 January 2015, the Administrative Tribunal registered two appeals (No. 559/2014 – Maria-Lucia ORISTANIO v. Governor of the Council of Europe Development Bank and No. 560/2015 – Nataliya YAKIMOVA v. Secretary General). In the first appeal, the appellant is complaining of a deterioration of her working conditions, a downgrading, a moral harassment and a disguised disciplinary measure under the guise of a reorganization. She contests the refusal of her demand to be reestablished in the integrality of her duties. In the second appeal, the appellant is complaining about the Secretary General’s refusal to effect advancement in step after 24 months of service (article 3 of Appendix IV to the Staff Regulations). She also challenges the exclusion of probationary period from the term of service in the calculations for the purposes of advances of steps

This information is given to enable those who so wish to exercise their right to intervene under Article 10 of the Statute of the Administrative Tribunal.

Extension of the jurisdiction of the Administrative Tribunal of the Council of Europe to the staff of the Central Commission for the Navigation of the Rhine (CCNR)

16.01.2015 - On 16 December 2014, the Council of Europe signed an Agreement with the Central Commission for the Navigation of the Rhine (CCNR) – an international organisation enjoying immunity – allowing the Administrative Tribunal of the Council of Europe to examine the related disputes between this organisation and its staff members.

This Agreement followed the amendment of Article 15 of the Statute of the Administrative Tribunal (Annex XI to the Staff Regulations), which has extended the jurisdiction of the Tribunal to cover disputes between international governmental organisations other than the Council of Europe and their respective officials. The internal appeal procedure – prior to the referral to the Tribunal which will apply to agents of the Commission – is a procedure specific to this international organisation which involves a conciliator during the procedure. The conciliator will be appointed by the Chair of the Administrative Tribunal, after reviewing all the applications submitted to the Registry of the Administrative Tribunal.

12.05.2014 - The “Conference on best practices in resolving employment disputes in international organisations” hosted by the International Labour Office was held on 15 and 16 September 2014 in Geneva.


25.03.2014 - On the occasion of the 20th Anniversary of its establishment, the International Monetary Fund Administrative Tribunal organises on 4 April 2014 in Washington a Symposium entitled “The future of international administrative law: Harmonization? Fragmentation? Dialogue?”, which will bring together scholars, judges, counsel for applicants and international organisations’ representatives. On the preceding day, more than 70 Judges and Registry personnel, representing some fifteen international administrative tribunals, will be convened for private meetings. The Council of Europe Administrative Tribunal will be represented by Mr G. Malinverni, Deputy Chair, and Mr S. Sansotta, Registrar. The Chair Malinverni will do a presentation on “The Relationship between The Administrative Tribunal of the Council of Europe and the European Court of Human Rights” in session III of the programme.

The Administrative Tribunal of the Council f of Europe (ATCE), previously named the Council of Europe Appeals Board until 5 April 1994, is an international administrative court competent to hear complaints of the serving and former staff members of the Council of Europe against their employer.
