Back Extension of the jurisdiction of the Administrative Tribunal of the Council of Europe to the staff of the Central Commission for the Navigation of the Rhine (CCNR)

On 16 December 2014, the Council of Europe signed an Agreement with the Central Commission for the Navigation of the Rhine (CCNR) – an international organisation enjoying immunity – allowing the Administrative Tribunal of the Council of Europe to examine the related disputes between this organisation and its staff members.

This Agreement followed the amendment of Article 15 of the Statute of the Administrative Tribunal (Appendix XI to the Staff Regulations), which has extended the jurisdiction of the Tribunal to cover disputes between international governmental organisations other than the Council of Europe and their respective officials. The internal appeal procedure – prior to the referral to the Tribunal which will apply to agents of the Commission – is a procedure specific to this international organisation which involves a conciliator during the procedure. The conciliator will be appointed by the Chair of the Administrative Tribunal, after reviewing all the applications submitted to the Registry of the Administrative Tribunal.
