In the framework of the Project “Foster transparency of judicial decisions and enhancing the national implementation of the ECHR” (TJENI), a roundtable on the protection of personal data in the context of publication of judicial decisions was held on 28 February 2023 in Brussels.
This roundtable provided a platform for exchanges between more than 40 participants (in person and online), among them representatives of project beneficiaries from Cyprus, Hungary, Lithuania, Poland, Romania and Slovenia, as well as representatives of Ireland, and experts and representatives of the Registry of the European Court of Human Rights (ECtHR), the Court of Justice of the European Union (CJEU), and the European Data Protection Supervisor’s Office.
The roundtable provided an overview of relevant international regulatory framework, namely the Convention 108, its modernised version and the GDPR, as well as respective case law of the ECtHR and the CJEU on personal data protection in the context of online publication of judicial decisions. In particular, such questions as risks for private life, the right to be forgotten, rehabilitation and data retention periods have been given special attention.
Presentations and discussions on safeguards and remedies for ensuring the protection of the rights of individuals (including personal data protection) in relation to online publication of judicial decisions followed.
Finally, practical aspects of publication of judicial decisions were touched upon, including Data Protection Impact Assessment (DPIA), Data Processing Agreement (DPA), as well as data protection officers’ (DPOs) roles and responsibilities.
The discussions were supported by the representatives of the ECtHR, the European Union, Council of Europe and experts in the field of personal data protection enabling project partners to benefit from this knowledge-exchange and further transfer gained know-how to their respective authorities.
