Seminar on the Assessment of Mediation-Arbitration Practices

A two-day seminar was held in Istanbul on 20-21 June 2022 to raise awareness on the regulations in the areas of mediation and arbitration, and the practices implemented by leading organisations and institutions in the fields of international trade, investment and co-mediation, within the scope of the European Union-Council of Europe Joint Project on “Promoting Alternative Dispute Resolution in Turkey”.

The seminar was organised for the business circle, chambers of industry and commerce, law firms, mediators, arbitrators, law faculty students and other relevant stakeholders to brief them about the regulations, regulatory bodies, instruments, international agreements and methods in the fields of mediation and arbitration, including mediation-arbitration (Med-Arb) models and co-mediation mechanisms in international mediation. Throughout the seminar, participants were informed about mediation-arbitration (Med-Arb) practices and these practices were evaluated.

On the first day of the seminar, four sessions were held: advantages of mediation and arbitration for the business circle and lawyers, resolution of disputes through Med-Arb, arbitration procedure and investment arbitration, and party attorneyship in the Med-Arb process. On the second day, workshop sessions were held by dividing participants into 8 working groups consisting of 10 people. In the joint session held at the end of the workshops, presentations containing the opinions and recommendations of each group for the improvement of practices were presented to participants by each working group.

 

 

The Joint Project on “Promoting Alternative Dispute Resolution (ADR) in Turkey” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Ministry of Justice of the Republic of Türkiye – Directorate General for Criminals Affairs and Directorate General for Legal Affairs are the end beneficiaries of the Project. The Central Finance and Contracts Unit is the contracting authority.
