Within the framework of the European Union-Council of Europe Joint Project on "Promoting Alternative Dispute Resolution in Türkiye", the Roundtable Discussion on Mediation Practices in Property and Lease Ownership was held in Ankara on 10 January 2024. Participants included representatives of the Ministry of Justice Directorate General for Legal Affairs, lawyers, academicians, and mediators.
In 2023, the Law No. 6325 on Mediation in Civil Disputes was amended to expand the scope of the disputes subject to the application for mediation as a condition of litigation. In particular, it concerned:
- Disputes arising from the lease relationship,
- Disputes regarding the division of movable and immovable property and dissolution of partnership,
- Disputes arising from the Property Ownership Law,
- Disputes arising from the right of neighbour.
The roundtable was attended by a total of 100 participants, and the objective was to enhance the knowledge on these new areas within the scope of mediation. Presentations and discussions touched upon various topics such as types and nature of lease contracts, definite/indefinite term lease contracts, notice of termination in lease contracts and residential and roofed workplace lease contracts, lessor and tenant rights, lease determination and adjustment cases, eviction cases, disputes arising from workplace leases and commercial leases, mediation practices in property ownership and lease disputes.
The Project on “Promoting Alternative Dispute Resolution (ADR) in Türkiye” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Ministry of Justice of the Republic of Türkiye Directorate General for Criminals Affairs and Directorate General for Legal Affairs are the end beneficiaries of the Project. The Central Finance and Contracts Unit is the contracting authority of the project.
