New Model on Conciliation Started to be Implemented

The Training of Trainers for Specialised Conciliators was held on 14-16 December 2022, in the framework of the European Union-Council of Europe Joint Project titled “Promoting Alternative Dispute Resolution (ADR) in Turkey”. As part of the needs assessment and monitoring of the conciliation mechanism in the framework of this project, consultants recommended the specialisation of conciliators on cases which involved violence or juvenile parties. This training of trainers brought these recommendations into effect.

The training was attended by representatives of the Directorate General for Criminal Affairs of the Ministry of Justice, the Council of Europe project team, national and international consultants, and 30 selected participants who had attended the “Trainings of Trainers for Basic Training on Conciliation” held in June-September 2022.

Throughout the three-day event, trainings on conflict management and negotiation skills referring to the principles of the Council of Europe and European best practices were conducted. On the second and third day, trainings on managing the conciliation process for cases with juvenile parties, negligent injury offenses, offenses against physical integrity were delivered to the candidate specialised trainers. These trainings included sub-topics such as specific regulations in the Turkish legislation regarding children pushed to crime, determination and negotiation of the damage caused by negligent injury, the victim’s special situation in offenses against physical integrity. This allowed candidate specialised trainers to acquire expertise and technical knowledge on the aforementioned topics.

This training created the “specialised conciliator” title, which will hold significant importance for the development and implementation of conciliation in Türkiye. Specialised conciliators with technical expertise in specific topics will help the conciliation process to be completed in a more systematic and professional way and in accordance with the best interest of the child.

 

The Joint Project on “Promoting Alternative Dispute Resolution (ADR) in Turkey” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Ministry of Justice of the Republic of Türkiye – Directorate General for Criminals Affairs and Directorate General for Legal Affairs are the end beneficiaries of the Project. The Central Finance and Contracts Unit is the contracting authority.
