Mid-Term Assessment Visit was Conducted on Piloting New Models of Conciliation

Within the scope of the European Union-Council of Europe Joint Project on “Promoting Alternative Dispute Resolution (ADR) in Türkiye”, an expert review is being conducted on the development and piloting of new conciliation models to provide an effective conciliation scheme for users. This review contributes to the execution of the conciliation process in a more systematic and professional manner within the scope of specialised conciliator model which has been developed under the project.

In this regard, 3 one-day mid-term assessment visits were envisaged to be carried out in Ankara, İstanbul and Adana, which had been selected as pilot regions.

The first of the mid-term assessment visits took place on 30 October 2023 in Ankara, at the Ankara Courthouse. The visits were conducted as 3-session meetings with specialised conciliators, parties involved in the conciliation process and conciliation prosecutors with the participation of representatives of the Ministry of Justice, Directorate General for Criminal Affairs; Ali Ceyhun Ceylan, Deputy Chief Prosecutor in charge of conciliation at Ankara Courthouse and Council of Europe local experts.

After all visits are completed, a comprehensive report will be prepared to determine the extent to which the issues emphasised during the specialised conciliator training are experienced in practice, the errors encountered in the application of information regarding the general conciliation process, the issues on which these errors generally focus, and examples of correct implementation. The mid-term assessment report, which includes recommendations and new monitoring and assessment tools, will be disclosed to the public, and it is anticipated that the report will contribute to the legal amendment and policy development processes in the field.

 

 

The Project on “Promoting Alternative Dispute Resolution (ADR) in Türkiye” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Ministry of Justice of the Republic of Türkiye Directorate General for Criminals Affairs and Directorate General for Legal Affairs are the end beneficiaries of the Project. The Central Finance and Contracts Unit is the contracting authority of the project.
