Three separate cascade training events were organised under the Joint Project on Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State.
The first - training module 1on Legal Reasoning and Judgment Drafting - was held between 9-11 May 2022 in Antalya, with the contribution of Assoc. Prof Dr Tolga Şirin and Dr Erkan Duymaz, targeting 62 administrative judges from all over Turkey. The training focused on judgment drafting procedures, reasoning and interpretation in administrative judgments and reasoning within the scope of right to a fair trial.
The second training event, on Right to a Fair Trial and Reasonable Time, was conducted between 13-15 May 2022 in Antalya, with the contribution of Dr Yusuf Sertaç Serter, targeting 76 administrative and tax judges.
The third training event, on the European Court of Human Rights and the Turkish Constitutional Court Rulings in Administrative Judiciary, was held between 24-26 May 2022 in Gaziantep with the participation of 49 administrative and tax judges from various provinces of Turkey and with the participation of Prof Dr Burak Gemalmaz and Dr Erkan Duymaz as trainers. The training focused on the role of the Constitutional court in qualification of rights in the resolution of judgments, retrial after the judgments on violation of the Constitutional Court, right to property, administrative sanctions, rights and standards to be considered in disciplinary law, cases on right to protection of material and spiritual assets and law on protection of personal data.
The training events will target a total of 925 judges and court staff and will be further rolled out.
The Joint Project on Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State is co-funded by the European Union, the Council of Europe and the Republic of Turkey, and implemented by the Council of Europe. The Turkish Ministry of Justice - Directorate General for Legal Affairs is the end beneficiary of the Project. The Central Finance and Contracts Unit is the contracting authority of this Project.
