The Seminar on effective tools for mutual legal assistance took place in Strasbourg (Agora Building, Room G 02) on 2 November 2010, and gave the participants the opportunity to discuss the forms and guidelines prepared in the framework of a voluntary contribution project, the first phase of which was financed by Germany. The conclusions of the Seminar are available below. The purpose of this project is to create standard model request forms
for each State Party to the European Convention on Mutual Assistance in
Criminal Matters of 20th April 1959. The document DG-HL (2010) 06 will
form the basis for discussions. The model forms created in the framework of this project are not
intended to be mandatory, rather they will act as a practical tool aimed
at facilitating the drafting of mutual legal assistance requests by
practitioners and speeding up their execution by requested States. It is
anticipated that these forms will be customised by each State Party in
the light of its obligations under the Convention and its domestic
requirements, so as to ensure that mutual assistance requests are as
complete as possible from the outset. In addition, the forms will be
accompanied by guidelines for practitioners, intended to further
facilitate their use. |
