On the ground of the entitlement in Para 24 Section (4) of Act LV. of 1993 on Hungarian citizenship (in the following: “Cta”) Government herewith regulates in the following decree on the detailed rules of citizenship procedure:

Citizenship Application

Para 1

Citizenship applications regulated in Para 13 Section (1) of Act LV. of 1993 on Hungarian citizenship, shall be submitted on the forms determined in the annexes of this decree:
a)the naturalisation-re-naturalisation-application on Annex No.1.
b)the declaration on renunciation citizenship on Annex No.2;
c)the application for citizenship card on Annex No.3.

Para 2

(1)The Registrar, or the consul shall examine the identity and attest the signature of applicant on admission the citizenship application.
(2)An applicant residing abroad may have personal identify identification and signature attested by the competent authority at place of residence for this purpose. The application shall be sent to the competent Hungarian Consul. The Consul shall certify the attestation was performed by an authorised person.
(3)The Registrar or the Consul, within the deadline regulated in Para 13 Section (2) of Cta, shall forward the application together with the annexes to the Ministry of the Interior. Forwarding of the application may not be refused owing to the client not having annexed the documents required by law or by this Decree. The attention of applicant, however, must be called to the consequences of incompleteness and of failing to rectify.

Naturalisation and Re-Naturalisation Application

Para 3

(1)Address in Hungary and duration of residence shall be certified by the alien police.
(2)Clean record may be proved by a certificate of good character-or upon special notice from the Minister of the Interior by a certificate of a clean record issued by the authority competent over the foreign residence.
(3)Subsistence and residence shall be appropriately proved, particularly proper in this respect is such a certificate issued by an employer; a certificate of state or local government revenue authority on applicant having taxable income; a pension certificate; a contract on dwelling purchase or renting contract; and a declaration on admission providing housing and subsistence for the applicant.
(4)In addition to the documents required by Section (1) to (3), the application for preferential naturalisation and re-naturalisation shall have enclosed
a)applying for naturalisation on the ground of Para 4 Section (2) Point c) of Cta, the final decision in force of the Hungarian guardianship authority;
b)applying for naturalisation on the ground of Para 4 Section (2) Point d) of Cta, the decision of the refugee authority;
c)applying for naturalisation on the ground of Para 4 Section (3), and re-naturalisation (Para 5) of Cta, the documents certifying to or rendering probable the former Hungarian citizenship of applicant, or of applicant’s ascendents.
(5)When submitting a naturalisation application on the ground of Para 4 Section (2) Points a), b), and c), the Hungarian citizenship of the spouse, of the minor aged child, or of the adopter, shall be certified.
(6)Applying for naturalisation on the ground of Para 4 Sections (1) to (3) of Cta, the certificate on a successful examination in basic constitutional knowledge shall be attached.

Para 4

After the decision of the President of the Republic the Minister of the Interior shall forward to the Mayor competent over the place of residence of the applicant the document of naturalisation or re-naturalisation, or the notification of the rejection of the application.

Citizenship Oath and Pledge

Para 5

(1)The Mayor competent over the place of residence shall summon the naturalised and the re-naturalised person to take the oath or pledge, and provides for the solemn taking of the oath or pledge.
(2)The Mayor shall prepare a protocol in two copies on proceeding on the taking of the oath or pledge. The first copy of the protocol shall be sent to the Minister of the Interior, the second copy shall be filed and stored according to the regulations on basic documents of the Registry.
(3)The Mayor shall certify on the naturalisation or re-naturalisation document the fact and the time of the taking of the citizenship oath or pledge, and shall hand over the document to the naturalised, re-naturalised person.
(4)The Regitrar shall take care of registering in the domestic Registry the registrable events (birth, marriage, death) abroad of the person who became a Hungarian citizen, and in the case of a person registered in the Hungarian Regisitry as a foreign citizen, of registering in the Registry the acquisition of Hungarian citizenship.

Renunciation the Hungarian Citizenship

(1)The applicant shall attach to the declaration of renunciation the Hungarian citizenship
a)the certified record of birth, the documents proving his/her family status:
b)in proving foreign citizenship a certificate issued by the competent foreign authority, or an official note which shall testify to the probability of acquisition foreign citizenship (note of promise);
c)a certificate issued by central and local government taxation authority competent over the last residence in Hungary that applicant has no tax or any other public arrears in Hungary.
(2)Who had no residential address in Hungary shall officially declare that he/she has no tax or public arrears in Hungary.

Para 7

The Minister of the Interior shall be authorized by office to review whether or not any criminal proceedings are in process in Hungary against the person renunciation the Hungarian citizenship, and whether the sentenced punishment by a Hungarian court is not executable.

Para 8

(1)The Minister of the Interior shall send the documents issued on the acceptance of the renunciation, or the decision on the rejection of the application to the competent Hungarian Consul, who shall forward it to applicant.
(2)Before delivering the document the Consul shall withdraw the documents certifying the Hungarian citizenship of applicant.

Citizenship Card and Writ

Para 9

In the application for a citizenship card applicant shall note why is the card applied for, and in front of which authority is its utilisation intended.

Para 10

The request to ascertain citizenship (Para 12 Cta) shall be forwarded by the authority directly to the Minister of the Interior. In the writ the authority shall provide the data (Para 14 Section (1) Cta) needed to ascertain citizenship.

Para 11

(1)The personal data needed to issue the citizenship card must be contained in the declaration made on the ground of Para 21 Section (1) of Cta.
(2)Who lost Hungarian citizenship by release shall attach to the declaration the document of release.
(3)Who lost Hungarian citizenship as a person compelled to relocate to Germany shall prove this fact by document or shall prove the probability authentically in an other way.

Decision

Para 12

In the citizenship procedure the decision made by the Minister of the Interior shall contain
a)the name of the authority making the decision, the number of the case, the name and residential address of the applicant;
b)the decision in the citizenship case, and information on the possibility for legal remedy;
c)the facts, proof, and legal regulations substantiating the decision;
d)the place, the time of the decision, the name of the signatory, the official seal of the decision making authority.

Examination

Para 13

(1)Applicant may go up for the examination regulated in Para 4 Section (1) Point e) of Cta at the office of the President’s Commissioner competent over applicant’s place of residence.
(2)The President’s Commissioner shall organise the examination, and shall
a)determine how the examination is taken;
b)set the date for the examination;
c)appoint the chaiman and two members of the examination committee;
d)prepare a registration sheet on applicant;
e)decide on the equitable reduction of or exemption from paying fee.
(3)The chairman and member of the examination committee shall be
a)civil servants possessing a university degree in state and legal sciences, or administration management qualifications;
b)a teacher possessing a higher education degree teaching in elementary school the subject of basic knowledge on citizenship.
(4)The requirements are defined in Annex No.4 to the Decree.
(5)The result of the candidate at the examination shall be evaluated as “satisfactory” or “not satisfactory”. The examination committee shall prepare a protocol on the examination, and shall issue a certificate to candidate on a successful examination.
(6)Applicant shall pay a fee for the examination. The size of the fee is fifty per cent of the current lowest mandatory monthly wage. The President’s Commissioner shall inform applicant about the amount of the fee. The fee shall be credited to the office of the President’s Commissioner, and shall be used to cover the costs of the examination.

Provisional and Final Clauses

Para 14

The application of those who had been released from the ties of Hungarian citizenship (1) during the period between 15 September 1947 and 2 may 1990, furthermore, of those whose Hungarian citizenship had ceased owing to relocation in Germany and whose re-naturalisation application has not been decided yet, must be settled according to Para 21 of Cta. The day of acquisition of Hungarian citizenship is the day the Decree enters into force.
(2)In the cases of release not decided yet when Cta enters into force, the regulations of Para 8 Section (2) of the Act shall be applicable.

This Decree enters into force on the day of 1 October 1993.
