A CASEBOOK ON THE RIGHT TO A FAIR TRIAL IN ADMINISTRATIVE JUSTICE HAS BEEN PUBLISHED

Aiming to raise awareness of the Turkish administrative justice community on human rights, the Casebook on the Right to a Fair Trial in Administrative Justice was prepared and published under the scope of the European Union and Council of Europe Joint Project on “Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State”. The book will be shared with the administrative justice community and the project’s stakeholders.

 

This publication, contributed by Prof Sibel İnceoğlu, Assoc. Prof Dr Nilay Arat and Dr Erkan Duymaz, includes basic and updated case law of the European Court of Human Rights, the Turkish Constitutional Court and the Council of State. During the preparation of this publication a tailored approach to the Casebook on European Fair Trial Standards in Administrative Justice published by the Council of Europe and Folke Bernadotte Academy (Sweden), which was translated to Turkish in September 2020 by the project, was adopted.

Ensuring access to precedents and establishing a reference book for the training efforts, the book aims to contribute to consistency of the case law while helping practitioners in the field of administrative justice to ensure the observance of the fair trial standards and their principles applicable under Article 6, paragraph 1 of the European Convention on Human Rights and, in doing so, contributing to practices in the field of the rule of law.

The Joint Project on Improving the Effectiveness of the Administrative Judiciary and Strengthening the Institutional Capacity of the Council of State is co-funded by the European Union, the Council of Europe and the Republic of Türkiye, and implemented by the Council of Europe. The Turkish Ministry of Justice - Directorate General for Legal Affairs is the end beneficiary of the Project. The Central Finance and Contracts Unit is the contracting authority of this Project.
