Italy ratified the 1961 European Social Charter on 22/10/1965 and the Revised Social Charter on 5/07/1999, accepting 97 out of 98 paragraphs.

It ratified on 3/11/1997 the 1995 Additional Protocol providing for a system of collective complaints, but has not made yet a declaration enabling national NGOs to submit collective complaints.

Collective complaints procedure

Italy ratified on 3/11/1997 the 1995 Additional Protocol providing for a system of collective complaints, but has not made yet a declaration enabling national NGOs to submit collective complaints.

Back No. 223/2023 Associazione professionale sindacale dirigenti area istruzione e ricerca (Dirigentiscuola) v. Italy

The complaint was registered on 15 March 2023. It concerns Article E (non-discrimination) in conjunction with Articles 2 (right to just conditions of work), 4 (right to a fair remuneration), 20 (the right to equal opportunities and equal treatment in matters of employment and occupation without discrimination on the grounds of sex), 22 (the right to take part in the determination and improvement of the working conditions and working environment) and 26 (the right of dignity at work) of the revised European Social Charter. Dirigentiscuola alleges that although Article 25 of Decree-Law No. 165/2001 recognises the status of manager for school directors, Italy has still not ensured equal pay for school directors and other State managers of the same rank, in violation of the aforementioned provisions of the Charter.
