European Committee of Social Rights: follow-up to decisions in collective complains in 2020

In 2020 the European Committee of Social Rights will examine the follow-up given to the decisions on the merits of collective complaints in which the Committee had found violations concerning Belgium, Bulgaria, Finland, France, Greece, Ireland, Italy, Portugal (list of the decisions to be examined).

Under the follow-up, the respondent State must provide information in its report on the measures taken to give effect to the European Committee of Social Rights’ decision, taking into account the recommendation or resolution adopted by the Committee of Ministers. The procedure is similar to the execution of the judgments of the European Court of Human Rights.

Decisions and documents adopted by the Committee of Ministers in the framework of the collective complaints procedure are available on HUDOC Charter Database.

Ultimately, it falls to the European Committee of Social Rights to determine whether the situation has been brought into conformity with the Charter.

In this context, trade unions, employers’ organisations, non-governmental organisations and independent state institutions are invited to submit comments on the follow-up of the Committee’s decisions by 30 June 2020.

The latest findings on the follow-up to decisions in the collective complaints procedure with respect to Belgium, Bulgaria, Finland, France, Greece, Ireland, Italy and Portugal were adopted in 2018 (Findings 2018).
