Prosecutors and law enforcement strengthen capacity to address ill-treatment in state custody

Preventing and effectively addressing allegations of ill-treatment in state custody requires close cooperation between legal and medical professionals. Strengthening this cooperation and ensuring compliance with European human rights standards were at the centre of a specialised workshop that brought together prosecutors and law enforcement representatives from across all territorial units of the Republic of Moldova.

The programme focused on aligning national practices with European human rights standards and with the medical and legal obligations applicable to persons deprived of liberty. Participants enhanced their understanding of European standards on the prohibition of torture and ill-treatment, including standards developed by the European Committee for the Prevention of Torture and those reflected in the Istanbul Protocol. The workshop also reviewed national procedures for identifying, documenting and reporting injuries, with particular attention to the responsibilities of police officers, prosecutors and medical personnel.

Through thematic presentations, case studies and group exercises, participants examined practical challenges in documenting injuries and responding to allegations of ill-treatment. Discussions highlighted common gaps in medical reporting and explored concrete ways to strengthen evidence collection and ensure compliance with human rights safeguards.

The programme further addressed health-related risks in detention, such as emergency medical care, prevention of communicable diseases and the protection of vulnerable persons, including those with mental health conditions or substance-use disorders. Participants emphasised the importance of coordinated action and effective information exchange among police, prosecutors, medical staff and forensic experts.

The workshop provided a platform to consolidate expertise and identify targeted measures to enhance documentation, reporting and inter-institutional cooperation. These efforts are key to advancing accountability and ensuring full respect for the absolute prohibition of torture and ill-treatment in line with the European human rights standards.

The event was organised within the framework of the Council of Europe Project “Strengthening the human rights compliant criminal justice system in the Republic of Moldova phase II”, which is part of the Council of Europe Action Plan for the Republic of Moldova for 2025-2028.
