Human Rights Workshop on Applying European Standards in Disciplinary and Evaluation Processes for Judges and Prosecutors

On 8 December 2025, a workshop on human rights standards in evaluation and disciplinary proceedings for judges and prosecutors was held in Chișinău. The event brought together 25 participants, including judges and judicial assistants of the Supreme Court of Justice, as well as representatives of the Superior Council of Magistracy and the Superior Council of Prosecutors.

The workshop focused on the substantive human rights standards applicable to disciplinary liability and extraordinary evaluation proceedings, with particular attention to judicial independence and the guarantees of a fair trial under European standards.

Participants examined how legal safeguards should operate in systems that must balance accountability with judicial independence. They discussed extensively the relevant case law of the European Court of Human Rights, as well as principles developed by the Court of Justice of the European Union in this field. Comparative approaches were explored in relation to judicial ethics, the standards of proof applicable in such proceedings, the system of disciplinary sanctions, and the independence of self-governing bodies involved in these processes.

The workshop was organised jointly by  the Council of Europe Project “Strengthening the Institutional Capacity of the Supreme Court of Justice” and the EU–Council of Europe Joint Project “Support to the Justice Reform in the Republic of Moldova” projects.
