The working group meeting on the ToT methodology took place online with the participation of six national experts consisting of prominent human rights practitioners and academics, representatives of the Turkish Constitutional Court (TCC), and the Council of Europe Project team. The meeting initiated the discussions on the format, methodology and the technical content of the 14 ToT sessions planned under the Project.
Concerning the audience of the ToTs, the experts reaffirmed the project work plan, and agreed that the ToTs should focus on the members of the judiciary. In recognition of the crucial role that the lawyers and the civil society organisations play in effective implementation of the TCC’s case law, they further recommended the involvement of these actors in project activities, including the ToTs. As for the content, it was agreed for the sessions to feature the binding nature of the TCC judgments and equip participants with relevant skills to interpret judgments of the TCC. The suggestion of a rights-based structuring of the ToT was mainly accepted with the caution that the ToTs are to be designed around implementation/execution-related questions. Considering the novice character of the theme, the experts agreed that a comprehensive introductory material (e.g. similar to a HELP module) be distributed among the participants prior to any ToT session. They further stressed the importance of carefully identifying the participants for both the ToTs and the cascade training that will follow.
The Joint Project on “Supporting the Effective Implementation of Turkish Constitutional Court Judgments in the Field of Fundamental Rights” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Turkish Constitutional Court is the end beneficiary of the Project.
