Methodology and Tools for Monitoring Conciliation Mechanism in Turkey

The second meeting on conducting monitoring of the conciliation mechanism under the European Union-Council of Europe Joint Project on “Promoting Alternative Dispute Resolution in Turkey” was held online on 20 October 2021 with the participation of the Directorate General for Criminal Affairs of the Ministry of Justice, the Council of Europe project team, and national and international consultants.

The methodology and tools for the monitoring of the conciliation mechanism in Turkey were discussed ahead of the on-site monitoring visits in Istanbul, Ankara and Adana which are scheduled to be held in November 2021. The methodology aims at collecting information on several data sets, such as appropriateness of the types of crimes, time frames, results of the conciliation process, qualifications of conciliators in order to monitor the functioning of conciliation in criminal matters. Several tools were designed to enable the measurement of the perception of legal practitioners (judges, prosecutors, conciliators, lawyers, and court staff) and victims, offenders on the functioning of the conciliation mechanism in Turkey. The consultants have also worked on the development of methodology of survey, which will be conducted by an independent (external) research company to complement the data collection and analysis process.

The Joint Project on “Promoting Alternative Dispute Resolution (ADR) in Turkey” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Ministry of Justice of the Republic of Turkey – Directorate General for Criminals Affairs and Directorate General for Legal Affairs are the end beneficiaries of the Project. The Central Finance and Contracts Unit is the contracting authority.
