Court finds violations of boy's
rights in rape case
The European Court of
Human Rights ruled, in its judgment of the case C.A.S.
and C.S. v. Romania (application n° 26692/05), that the
Romanian authorities should have carried out an
effective investigation of the repeated rape of a
seven-year-old boy and made sure he had counselling. The
Court held that there had been a violation of Article 3
(prohibition of inhuman or degrading treatment and
effective investigation) and of Article 8 (right to
respect for private and family life and the home) of the
European Convention of Human Rights.
During the Court's deliberations, it was pointed out
that states had an obligation to ensure effective
criminal investigation of cases involving violence
against children, in maintaining their best interests
and in protecting children against any form of abuse,
including helping recovery and social integration of
victims.
