The Group of Specialists on Human Rights
and the Fight against Terrorism (DH-S-TER) was set up in 2001 in order
to elaborate guidelines, based on the principles of protection of human
rights, respect for democracy and the rule of law, for member States’ when taking action against terrorism. This work resulted in the
adoption, in July 2002, of Guidelines on Human Rights
and the Fight against Terrorism by the Committee of Ministers of the
Council of Europe. Following the terrorists acts which occurred in
Madrid in March 2004, the Group continued by preparing draft guidelines on the protection of vistims of terrorists acts, which were adopted by the Committee of Ministers in 2005.
The Group then continued to consider and, ultimately, reject the possibility of drafting a legal instrument on minimum requirements/standards for the use of diplomatic assurances in the context of expulsion procedures, in the framework of the fight against terrorism, in cases where ther is a risk of torture or inhuman or degrading treatment or punishment.
