During its 2nd meeting (8–10 November 2016), the Committee of experts on the system of the European Convention of Human Rights (DH-SYSC) examined the elements identified by the DH-SYSC-I Group during its 2nd meeting (19–21 October 2016, see document DH-SYSC-I (2016)R2, Appendix III), pronounced itself on the four themes identified (the selection procedure, the election process, conditions of employment and working conditions at the Court and ad hoc judges) and gave guidance for the future work (see paragraphs 6 to 14 of the meeting report (DH-SYSC(2016)R2)).

The DH-SYSC has instructed the Secretariat to prepare a revised version of the working document based on comments formulated during its discussions and of DH-SYSC-I during its 2nd meeting, as well as all new contributions of experts, who were invited to send them by Wednesday 14 December 2016, and of all the actors concerned. It is recalled that an exchange of views took place last April (1st meeting of the DH-SYSC (25–27 April 2016)) with the Secretary General of the Parliamentary Assembly, the Registrar of the Court, and the President of the Advisory Panel. An exchange of views has then taken place with the Director of Legal Advice and Public International Law, related to the functioning of the Advisory Panel (1st meeting of the DH-SYSC-I (29 June–1 July 2016)), and with the Secretary General of the Parliamentary Assembly last October (2nd meeting of the DH-SYSC-I (19–21 October 2016)).

During its 86th meeting, the CDDH welcomed the results of the work to date and endorsed the guidance given by the DH-SYSC to the DH-SYSC-I. Furthermore, it responded positively to the request to hold a 4th meeting of the DH-SYSC-I given the importance of the work for the system of the Convention as well as their scope.

It is recalled that the Court’s Status Committee would meet in view of the drafting of its contribution to this work which will be submitted to the Court sitting in plenary session with a view to its transmission in due course before the present meeting. The contribution of the Court, as adopted in plenary session, was submitted on 23 February 2017.

      The Group is invited to examine the working document prepared by the Secretariat in light of the comments and the guidance given by the DH-SYSC, the comments formulated at the 2nd meeting of the DH-SYSC-I, as well as new contributions received from experts and all actors concerned. The Group is also invited to hold an exchange of views with Judge Ganna Yudkivska, President of the Fourth Section of the Court, who will present the contribution of the Court.
