Montenegro becomes the 30th State
to ratify the Revised Charter
On 3 March
2010 the Permanent Representative of
Montenegro, Ambassador Zoran
JANKOVIC transmitted to Thorbjorn JAGLAND
the instruments of ratification for the
Revised European Social Charter (entry into force
on 10/05/2010.
Mrs Polonca KONCAR, President of the
European Committee of Social Rights welcomed this
ratification and commended Montenegro for its
commitment to core social rights and noted with
satisfaction that the ratification had been helped
along by good cooperation between the Montenegrin
authorities and the Council of Europe. Mrs
KONCAR expressed her hope that the four member
states that have not yet ratified the Charter
(Liechtenstein, Monaco, San Marino and
Switzerland) will do so in the near
future.

Reporting
System
The Estonian Parliament adopts a
law restricting the length of alternative
service
In
its Conclusions for 2006 and
2008, the
European Committee of Social Rights declared that
Estonian legislation, with regard to alternative
service, did not comply with Article
1§2 (freely undertaken work) of the
European Social Charter Revised. This
provision stipulates that the duration of
alternative service may not exceed one and a half
times the length of military service. The
Committee ruled that the length of
alternative service in Estonia was excessive
and therefore interfered with a person's right to
earn his living in an occupation freely
entered upon.
The Estonian Parliament recently passed
amendments to the Defense Forces Service Act
shortening alternative service from the
current 12-18 months to 8-12 months as of July
2010, with a view
to bringing Estonia's situation into
conformity with the Revised Charter.

The national reports for the
current reporting cycle concern the following
provisions related to Thematic Group
3 (Labour
Rights): 2 (right
to just conditions of
work ), 4 (right to a
fair remuneration), 5 (right to
organise), 6 (right to
bargain collectively), 21,or
Article 2 of the Additional
Protocol (right of workers to be
informed and consulted), 22, or
Article 3 of the Additional
Protocol (right of workers to take part in
the determination and improvement of working
conditions and working
environment), 26 (right to
dignity in the workplace), 28
(right of workers' representatives to
protection in the undertaking and facilities to be
accorded to them), 29 (right to
information and consultation in procedures of
collective redundancy).
The deadline for submitting reports
was 31 October 2009.
The following States have
not submitted their reports to
date:
Iceland, Finland, Ireland and
Luxembourg
The conclusions adopted by the
Committee will be made public by the end of
2010.
