Back No. 232/2023 Associazione Nazionale per l'lndustria e il Terziario (A.N.P.I.T.) and Confederazione Italiana Sindacati Autonomi Lavoratori (C.I.S.A.L.) v. Italy

The complaint was registered on 13 November 2023. It concerns Articles 5 (the right to organise), 6 (the right to bargain collectively) and 12 (the right to social security) of the Revised European Social Charter. The complainant organisations, A.N.P.I.T. and C.I.S.A.L., allege that the Italian legislation that regulates the access to the wage supplementation fund in derogation during the Covid-19 emergency is discriminatory and unfair, since it requires an agreement with the comparatively most representative trade unions at national level, excluding in some cases those which have signed the collective agreements applied in the undertaking, in disregard of the principles of pluralism, representativeness and effectiveness of trade union action and in breach of the aforementioned provisions of the Charter.
