The complaint was registered on 13 May 2026. It was lodged by the European Confederation of Police (EuroCOP), the Association of Garda Sergeants and Inspectors (AGSI) and the Garda Representative Association (GRA).
The complainant organisations allege that Ireland is not in conformity with Articles 5 (right to organise), 6§2 (right to bargain collectively) and 6§4 (right to collective action) of the European Social Charter. They allege that the situation giving rise to the findings of violation adopted by the European Committee of Social Rights in Complaint No. 83/2012, European Confederation of Police (EuroCOP) v. Ireland, has not been adequately remedied.
In particular, the complainant organisations allege that members of An Garda Síochána continue to face restrictions concerning freedom of association, collective bargaining and collective action. They further allege that legislative and disciplinary reforms adopted in recent years have had a negative impact on the employment and collective rights of Garda members.
