Denmark puts the spotlight on court mediation
The Danish Court Administration has recently updated and optimized the training provided to mediators to meet the increasing demands for conflict resolution in complex cases. In 2023, the default option for mediation in digital civil cases was changed from ‘no, thanks’ to ‘yes, please,’ requiring parties to actively opt out if they prefer not to seek an out-of-court resolution. Additionally, in June this year, legal procedures were simplified, allowing courts to convene preliminary hearings solely to discuss the possibility of direct mediation. An informational video on mediation has also been launched to encourage more parties to engage in dialogue. This video is now available with English subtitles in connection with the European Day of Justice.
