 The European Committee of Social Rights is the monitoring body of the European Social Charter. It is composed of 15 independent, impartial members which are elected by the Council of Europe’s Committee of Ministers for a period of six years, renewable once.

 The European Committee of Social Rights rules on the conformity of the situation in States with the Charter under two complementary mechanisms: through collective complaints lodged by the social partners and governmental organisations (collective complaints procedure), and through national reports drawn up by the States Parties (reporting procedure).

 States Parties have an obligation to cooperate with the Committee and its jurisprudence (both “decisions” in complaints and “conclusions” on the basis of national reports). This obligation arises from the application of the principle of good faith to the observance of all treaty obligations. For States Parties to ignore or not take into account the Committee’s decisions and conclusions would be to fail to show good faith in implementing their Charter-based obligations.

European Committee of Social Rights: election of members for the term 2025-2030

The Committee of Ministers of the Council of Europe, at the 1500th meeting of the Ministers’ Deputies on 5 June 2023, adopted the procedure CM/Del/Dec(2024)1500/4.3c  for filling the five seats on the European Committee of Social Rights falling vacant on 31 December 2024, with the terms for these seats beginning 1 January 2025 and ending on 31 December 2030.

States Parties to the European Social Charter belonging to the Groups of States concerned (see below) may submit to the Secretary General of the Council of Europe, no later than 27 September 2024, the name of a candidate it deems suitable.

The vacant seats are as follows:

  • Group I: one seat vacant
    Armenia, Austria, Czech Republic, Germany, Hungary, Liechtenstein*, Slovak Republic, Slovenia and Switzerland*

  • Group II: two seats vacant
    Belgium, Bulgaria, France, Lithuania, Luxembourg, Monaco, Netherlands, Poland and Romania
  • Group V: three seats vacant

         Albania, Azerbaijan, Bosnia and Herzegovina, Republic of Moldova, Montenegro, Serbia, North Macedonia, Turkey and Ukraine

It is recalled that only States Parties to the Charter may nominate candidates and there may be no more than one member of any nationality in the Committee. For the current composition of the Committee, see here : Members of the European Committee of Social Rights - Social Rights (coe.int)
