All four appellate courts, commercial courts, and the Supreme Court of Serbia held their second meeting this year as part of the practice of quarterly meetings between civil case-law departments. The meeting took place in Belgrade on 13 June 2025, with the support of the joint EU/CoE project “Support for the Implementation of Judicial Reform in Serbia”.
Judges from the appellate courts presented selected legal issues that had arisen in recent practice, illustrating them with examples of conflicting decisions in comparable cases. Several key legal questions were discussed, with representatives from all four appellate courts actively exchanging views. The participants explained the reasoning behind their differing positions, while a Supreme Court judge offered the Court’s legal position on the disputed matters. The meeting featured an engaging legal debate focused on the practical consequences of divergent interpretations. After thorough consideration of the differing perspectives, a joint position was ultimately agreed upon in several cases.
The joint EU/CoE project “Support for the Implementation of Judicial Reform in Serbia” will continue to facilitate meetings aimed at case-law harmonisation. The project seeks to raise awareness of the importance of exchanging legal stances and diverse opinions in order to strengthen the rule of law in Serbia.
