Sixth training successfully implemented in two online sessions due to huge interest of participants

The two-day training on “Application of the principle of proportionality in Art. 1 P1 cases” took place online on 17 and 20 March 2023 and on 02 and 03 May. The training was delivered in two sessions due to a huge interest for the training topic reflected in 63 applications from judges of municipal and administrative as well as county courts from all over Croatia. The training was delivered by four tutors Ms Štefica Stažnik, Croatian Representative before the European Court of Human Rights, Mr Fran Krsto Očić, Senior Advisor, Croatian Representative before the European Court of Human Rights, Ms Goranka Barać Ručević, Judge of the Supreme Court of the Republic of Croatia, Ms Morana Briški, senior advisor at the Supreme Court of the Republic of Croatia.

The agenda included introduction to the Convention protection of property and connection to the Croatian law and the participants were made acquainted with proportionality test – legality, legitimate objective and proportionality in the case law of the ECtHR covering Croatian and other cases. In addition, concepts of ownership, tenancy rights and right to a home as well as state liability for damage to property temporarily disposed were presented. The agenda of the second training day included Usucaption case-law of the ECtHR as well as case-law of the ECtHR and the Supreme Court of the Republic of Croatia on obligation to refund the paid benefit.  

This is the sixth training session in the training program developed under the Project in consultation with the project partners – the Judicial Academy of Croatia and the Office of the Representative of the Republic of Croatia before the European Court of Human Rights. The training programme is based on the recommendations from the Training Needs Assessment and takes into account the interests of target groups (criminal, civil, and administrative law practitioners), the availability of respective materials and HELP courses adapted for Croatia, and the recommendations of CoE monitoring bodies.

The Project “Promotion of the rule of law and fundamental rights through high-quality online trainings in the Croatian Judiciary” is aimed at providing support to the Judicial Academy of Croatia to improve the methodology, tools and expertise to design and deliver high-quality training.

The Project is co-funded by the European Union via the Technical Support Instrument, and implemented by the Council of Europe, in cooperation with the European Commission, the Directorate-General for Structural Reform Support (DG REFORM).
