The fourth two-day online training on legal reasoning and legal drafting in criminal cases with the consideration of the European Human Rights Court’s case law and decisions of the Constitutional Court of Bosnia and Herzegovina is organised on 26 and 27 April 2021. The training is attended by 35 judges and legal advisors from Bosnia and Herzegovina.

The training is focused on the obligation of courts to provide sufficient reasons for their decisions in accordance with Article 6. 1 of the European Convention on Human Rights - the right to a fair trial. The training elaborates on how to give thorough arguments for factual and legal conclusions. An important part of the training is also the personalisation of the rationale of decisions on pre-trial detention, where general conditions that are pre-defined by the law should be elaborated with the consideration of individual circumstances.

This activity is organised in co-operation with the Judicial and Prosecutorial Training Centres of Republika Srpska and Federation of Bosnia and Herzegovina within the project: “Initiative for Legal Certainty and Efficient Judiciary in Bosnia and Herzegovina – Phase II” implemented by the Council of Europe and funded by the Kingdom of Norway.
