Round Table: Execution of Strasbourg Court's judgments on property restitution and compensation

This Round Table was organised by the Council of Europe in cooperation with the Ministry of Foreign Affairs of Romania, with the support of the Council of Europe Human Rights Trust Fund.

Venue: Howard Johnson Hotel, Bucharest, Romania

Description: In the last two decades, Central and Eastern European states have faced legal and financial challenges in finding a solution to the restitution of and/or compensation for properties nationalised before 1989. Several states have adopted legislation aimed at solving this issue which affects thousands of people.

Hundreds of claimants have turned to the European Court of Human Rights which identified in its judgments various shortcomings in the restitution/compensation mechanisms. Such cases represent an important case-load for the European Court. The execution of the Court’s judgments is primarily the responsibility of states. The Committee of Ministers of the Council of Europe supervises the measures taken by states to execute these judgments.

The round table “Property restitution/compensation: general measures to comply with the European Court´s judgments” aims to discuss possible ways to tackle such challenges and solve the outstanding issues at national level. Proposed solutions, drawn from the experience of participating states, should contribute to stemming the flow of similar applications to the Strasbourg Court.
