At its 45th plenary meeting, the Committee of Convention 108 (T-PD) adopted the second module of the Model Contractual Clauses for transborder data flows of personal data, based on the modernised Convention 108+ for the protection of individuals with regard to the processing of personal data. This second module addresses the transfer of personal data from controller to processor and thus complements the first module of these clauses which deals with transborder data flow from data controller to data controller adopted by the T-PD on 16 June 2023. With this second module, competent authorities can pre-approve transborder data flows in order to facilitate international data flows and to contribute to the convergence towards appropriate global data protection standards. A third module dedicated to the transfer of personal data from processor to processor will be soon developed to complete this work.
