BRIEF DESCRIPTION OF THE PROJECT

The project will be implemented in Ukraine, in co-operation with the Ukrainian counterparts – the Government Agent before the European Court of Human Rights, the Parliamentary Sub-Committee on the Execution of Judgments of the European Court of Human Rights, the Supreme Court. The project is managed by the Justice and Legal Co-Operation Department of the Directorate General Human Rights and Rule of Law.

OVERALL PROJECT OBJECTIVE

To support Ukraine in the improvement of its national system of execution of judgments of the European Court of Human Rights that involve violations of Article 6 of the European Convention on Human Rights, where the root cause is a dysfunction within the judiciary.

SPECIFIC PROJECT OBJECTIVES

  • Specific objective 1

To support Ukraine in further implementation of the Council of Europe standards on the organisation and functioning of the judiciary so as to provide for a better judicial independence, in line with the judgment of the European Court of Human Rights “Oleksandr Volkov v. Ukraine” and the “Salov v. Ukraine” group of judgments.

  • Specific objective 2

To support the Ukrainian authorities in installing an effective system of remedies from alleged violations of the European Convention on Human Rights, in particular from non-enforcement of domestic judgments and from lengthy judicial proceedings.

  • Specific objective 3

To support Ukraine in establishing effective mechanisms of co-operation between the legislative, executive and judicial branches of power aimed at full, coherent and effective execution of judgments of the European Court of Human Rights.

EXPECTED RESULTS

The functioning of the system of disciplinary proceedings against judges and the dismissal of judges, as defined by the amended Ukrainian legislation, is organised in accordance with the standards and recommendations of the Council of Europe and provides for a better judicial independence, in line with judgments “Oleksandr Volkov v. Ukraine” and the “Salov v. Ukraine” group of judgments.

The Ukrainian system of execution of judgments of the European Court of Human Rights establishes effective procedures for the preventive and compensatory remedies to tackle the problems of the non-execution of domestic judgments (cases “Yuriy Nikolayevich Ivanov v. Ukraine” and “Burmych and others v. Ukraine”) and the lengthy judicial proceedings (cases “Svetlana Naumenko v. Ukraine” and “Merit v. Ukraine”).

Following the amended legislation of Ukraine, the new Supreme Court enacts the effective mechanisms of interaction with the European Court of Human Rights, including the procedure of the re-opening of judicial proceedings following a finding of a violation by the European Court of Human Rights (cases “Bochan v. Ukraine (no. 2)”, “Yaremenko v. Ukraine (no.2)” and “Shabelnik v. Ukraine (no.2)”) and the consultations procedure with the European Court of Human Rights within the framework of Protocol 16 of the European Convention on Human Rights.
