Azerbaijan submits its second Report pursuant to the Framework Convention for the Protection of National Minorities

Azerbaijan submitted its second state report in English, on 10 January 2007, pursuant to Article 25, paragraph 1, of the Framework Convention for the Protection of National Minorities. It is now up to the Advisory Committee to consider it and adopt an opinion intended for the Committee of Ministers.

The Committee of Ministers issues recommendations on minority protection in Finland, Malta and San Marino

The Committee of Ministers has just adopted resolutions on the protection of minorities in Finland, Malta and San Marino. These resolutions contain conclusions and recommendations, highlighting positive developments, but also a number of areas where further measures are needed to advance the implementation of the Framework Convention for the Protection of National Minorities.

The resolutions are largely based on the corresponding Opinions of the Advisory Committee on the Framework Convention. The detailed Opinions of the Advisory Committee of independent experts, together with the comments by the Governments of Finland, Malta and San Marino, are also available on line.

Switzerland submits its second Report pursuant to the Framework Convention for the Protection of National Minorities

Switzerland submitted today its second state report, in French, pursuant to Article 25, paragraph 1, of the Framework Convention for the Protection of National Minorities. It is now up to the Advisory Committee to consider it and adopt an opinion intended for the Committee of Ministers.

The Committee of Ministers issues recommendations on minority protection in Armenia and Germany

The Committee of Ministers has just adopted resolutions on the protection of national minorities in Armenia and Germany. These resolutions contain conclusions and recommendations, highlighting positive developments but also a number of areas where further measures are needed to advance the implementation of the Framework Convention for the Protection of National Minorities.

The Advisory Committee adopts opinions on Spain and "the former Yugoslav Republic of Macedonia"

The Advisory Committee on the Framework Convention for the Protection of National Minorities adopted two country-specific opinions this week under the second cycle of monitoring the implementation of this convention in States Parties.

The opinion on Spain was adopted on 22 February, and the opinion on “the former Yugoslav Republic of Macedonia” was adopted on 23 February.

These two opinions will now be submitted to the Committee of Ministers, which is to adopt conclusions and recommendations.

The comments of the Government of Ireland on the opinion of the Advisory Committee of the Council of Europe's Framework Convention for the Protection of National Minorities on measures taken in this field by Ireland, were received and made public at the country's initiative on 27 February 2007.

The Advisory Committee on the Framework Convention for the Protection of National Minorities visits the United Kingdom

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities is visiting the United Kingdom this week from 19-24 March 2007 in the context of the monitoring of the implementation of this convention in the United Kingdom. The visit is the 19th country visit conducted by the Advisory Committee in the second cycle of monitoring. The Committee is composed of 18 independent experts elected by the Committee of Ministers of the Council of Europe.

The United Kingdom submitted its second state report under the Framework Convention in February 2007, and the delegation of the Advisory Committee will be in the United Kingdom in order to seek further information. On the basis of this and other information, the Advisory Committee will subsequently adopt an opinion on how the United Kingdom has implemented the various articles of the Framework Convention.

The delegation includes the following members of the Advisory Committee:
Mr. Ivan GARVALOV (Bulgaria), Ms. Marju LAURISTIN (Estonia) and Ms. Eva SMITH-ASMUSSEN (Denmark), and will be assisted by Ms Elena JURADO of the Secretariat of the Framework Convention.

The Advisory Committee on the Framework Convention for the Protection of National Minorities visits Austria

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities is visiting Austria this week from 26-30 March 2007 in the context of the monitoring of the implementation of this convention in Austria. The visit is the 20th country visit conducted by the Advisory Committee in the second cycle of monitoring. The Committee is composed of 18 independent experts elected by the Committee of Ministers of the Council of Europe.

Austria submitted its second state report under the Framework Convention in December 2006, and the delegation of the Advisory Committee will be in Austria in order to seek further information. On the basis of this and other information, the Advisory Committee will subsequently adopt an opinion on how Austria has implemented the various articles of the Framework Convention.

The delegation consists Ms Arzu Aghdasi-Sisan, Member of the Advisory Committee elected in respect of the Republic of Azerbaijan, Mr Gjergj Sinani, Member elected in respect of Albania, Ms Regina Tavares da Silva, Member elected in respect of Portugal, and Ms Françoise Kempf of the Secretariat of the Framework Convention.

The Advisory Committee on the Framework Convention for the Protection of National Minorities visits Cyprus

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities is visiting Cyprus this week from 2 - 4 April 2007 in the context of the monitoring of the implementation of this convention in Cyprus. The visit is the 21st country visit conducted by the Advisory Committee in the second cycle of monitoring. The Committee is composed of 18 independent experts elected by the Committee of Ministers of the Council of Europe.

Cyprus submitted its second state report under the Framework Convention in October 2006, and the delegation of the Advisory Committee will be in Cyprus in order to seek further information. On the basis of this and other information, the Advisory Committee will subsequently adopt an opinion on how Cyprus has implemented the various articles of the Framework Convention.

The delegation consists Ms Ilze Brands-Kehris, Member of the Advisory Committee elected in respect of Latvia, Mr Gunnar Jansson, Member elected in respect of Finland, Mr Gjergj Sinani, Member elected in respect of Albania, and Ms Artemiza Tatiana Chisca of the Secretariat of the Framework Convention.

The Committee of Ministers appoints a new ordinary member to sit on the Advisory Committee on the Framework Convention

Mr Francesco PALERMO has been appointed in respect of Italy, as ordinary member of the Advisory Committee on the Framework Convention commencing on 12 April 2007 and expiring on 1 June 2010.

The Committee of Ministers issues recommendations on minority protection in the Russian Federation

The Committee of Ministers has just adopted a resolution on the protection of national minorities in the Russian Federation. This resolution contains conclusions and recommendations, highlighting positive developments but also a number of areas where further measures are needed to advance the implementation of the Framework Convention for the Protection of National Minorities.

The resolution is largely based on the corresponding Opinion of the Advisory Committee on the Framework Convention. The detailed Opinion of the Advisory Committee of independent experts, together with the comments by the government of the Russian Federation, are also available on line.

The Advisory Committee on the Framework Convention for the Protection of National Minorities visits Sweden

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities is visiting Sweden this week from 7 - 10 May 2007 in the context of the monitoring of the implementation of this convention in Sweden. The visit is the 22nd country visit conducted by the Advisory Committee in the second cycle of monitoring. The Committee is composed of 18 independent experts elected by the Committee of Ministers of the Council of Europe.

Sweden submitted its second state report under the Framework Convention in July 2006, and the delegation of the Advisory Committee will be in Sweden in order to seek further information. On the basis of this and other information, the Advisory Committee will subsequently adopt an opinion on how Sweden has implemented the various articles of the Framework Convention.

The delegation consists of Ms Marju LAURISTIN, Member of the Advisory Committee elected in respect of Estonia, Mr. Francesco PALERMO, Member of the Advisory Committee elected in respect of Italy, and Mr Antti KORKEAKIVI of the Secretariat of the Framework Convention.

Republic of Montenegro becomes the 47th Council of Europe member State

On 11 May, the Republic of Montenegro joined the Council of Europe as its 47th member. The accession ceremony took place in Strasbourg, just before the 117th session of the Organisation’s Committee of Ministers. The ceremony began at 9am with a statement by Terry Davis, Secretary General of the Organisation followed by a speech by Milan Rocen, Foreign Minister of the Republic of Montenegro.

The Advisory Committee adopts opinions on the United Kingdom, Cyprus and Austria

The Advisory Committee on the Framework Convention for the Protection of National Minorities adopted three country-specific opinions last week under the second cycle of monitoring the implementation of this convention in States Parties.

The opinion on the United Kingdom was adopted on 6 June, the opinion on Cyprus on 7 June and the opinion on Austria on 8 June.

These three opinions will now be submitted to the Committee of Ministers, which is to adopt conclusions and recommendations.

The Advisory Committee on the Framework Convention for the Protection of National Minorities visits Azerbaijan

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities visited Azerbaijan last week from 10 - 14 September 2007 in the context of the monitoring of the implementation of this convention in Azerbaijan. The visit was the 23rd country visit conducted by the Advisory Committee in the second cycle of monitoring. The Committee is composed of 18 independent experts elected by the Committee of Ministers of the Council of Europe.

Azerbaijan submitted its second state report under the Framework Convention in January 2007, and the delegation of the Advisory Committee was in Azerbaijan in order to seek further information. On the basis of this and other information, the Advisory Committee will subsequently adopt an opinion on how Azerbaijan has implemented the various articles of the Framework Convention.

Consultation Seminar on the "Draft commentary on participation of persons belonging to national minorities in cultural, social and economic life and public affairs"

A Consultation Seminar on the “Draft Commentary on Participation of Persons belonging to National Minorities in Cultural, Social and Economic Life and Public Affairs”, jointly organised by the Council of Europe and the European Academy of Bolzano (EURAC), is being held on 2 and 3 October 2007 in Bolzano/Bozen. The aim of the Seminar is to organise an exchange of views on participation with minority organisations and other stakeholders.

The authorities and the Council of Europe are organising a “follow-up seminar” today to discuss how the findings of the monitoring bodies of the Council of Europe’s Framework Convention for the Protection of National Minorities are being implemented in the Czech Republic.

National Minorities in the United Kingdom

The Opinion of the Advisory Committee on the Framework Convention for the Protection of National Minorities on the United Kingdom has just been made public together with the government’s comments.

The Advisory Committee – an expert body set up under the Council’s Framework Convention for the Protection of National Minorities - visited the United Kingdom in March 2007. In its report, the Committee examined the UK legislation and policy framework. It also looked at the implementation level in areas such as discrimination, intercultural dialogue and tolerance. Comments were also made regarding the use of minority languages, education in minority languages as well as the participation of minority communities in the public sector and in decision-making processes.

The Committee of Ministers will now draw on the report as it prepares a Resolution on the issue.

The Framework Convention is ratified by 39 States. The Convention includes a monitoring system, whereby the Committee of Ministers, assisted by an advisory committee, evaluates the adequacy of the Convention's implementation. The Opinions of the Advisory Committee are made public upon upon the adoption of the Committee of Ministers’ resolution but can be made public at an earlier stage at the country’s initiative.

The Advisory Committee adopts opinions on Sweden and Azerbaijan

The Advisory Committee on the Framework Convention for the Protection of National Minorities adopted two country-specific opinions last week under the second cycle of monitoring the implementation of this convention in States Parties.

The opinion on Sweden was adopted on 8 November and the opinion on Azerbaijan on 9 November.

These opinions will now be submitted to the Committee of Ministers, which is to adopt conclusions and recommendations.

The authorities and the Council of Europe are organising a “follow-up seminar” tomorrow to discuss how the findings of the monitoring bodies of the Council of Europe’s Framework Convention for the Protection of National Minorities are being implemented in Armenia.

The Advisory Committee on the Framework Convention for the Protection of National Minorities visits Switzerland

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities is visiting Switzerland (BERN – BUECH – FRIBOURG) this week from 19-21 November 2007. This visit is the second one in this country after that of 2002 and will facilitate the monitoring of the implementation of this treaty in Switzerland by the Advisory Committee.

The delegation will mainly discuss the legal and factual position of the linguistic minorities, including in the trilingual Canton of Graubünden and in the bilingual Cantons of Bern, Fribourg and Wallis. The situation of the Jewish community and of the Travellers will also be addressed, bearing in mind that both groups can rely on the protection offered by the Framework Convention. The visit will entail a special focus on the situation of the Travellers and the current situation in respect of transit sites and stopping places, with an on-the-spot visit of to the stopping place in Buech near Bern and an ensuing roundtable discussion in Fribourg on the same topic.

The delegation is to hold meetings in Bern with representatives of the Ministry of Foreign Affairs, members of Parliament and representatives of various offices from the federal administration. The delegation is also due to meet with several non-governmental associations representing minorities and/or promoting their language and culture, as well as general Human Rights NGOs. A session will be devoted to the linguistic situation and main issues faced by the multilingual Cantons, with representatives of the authorities and civil society. A decentralised roundtable will be held in Fribourg to discuss the situation of the Travellers in this canton, in the presence of the Prefect of the Sarine District and representatives from different municipalities.

The delegation consists of three experts, that is Ms Regina TAVARES DA SILVA (member of the Advisory Committee elected in respect of Portugal), Mr Ivan GARVALOV (member of the Advisory Committee elected in respect of Bulgaria) and Mr Dalibor JILEK (member of the Advisory Committee elected in respect of the Czech Republic), who are accompanied by Mr Alain CHABLAIS (Secretariat).

Note: Switzerland submitted its second state report in January 2007. Following its visit, the Advisory Committee will adopt its own report (called Opinion) in early 2008, which will be sent to the Swiss Government for comments. The Committee of Ministers of the Council of Europe will then adopt conclusions and recommendations in respect of Switzerland.

The Advisory Committee on the  Framework Convention for the Protection of National Minorities visits Lithuania

A delegation of the Advisory Committee on the Council of Europe’s Framework Convention for the Protection of National Minorities is visiting Lithuania from 19 to 22 November 2007. This is the Advisory Committee’s second visit to this country. Its aim is to facilitate the monitoring of the implementation of this treaty in Lithuania by the Advisory Committee.

Issues relating to the effective participation of persons belonging to national minorities in public affairs and socio-economic life will be raised. In this respect, integration of disadvantaged groups into society and relevant programmes in the field of employment, housing, health and education will be discussed. The delegation will also examine the issues relating to education in/of minority languages in schools and the use of minority languages in contacts with administrative authorities. The legislative framework pertaining to the protection of national minorities will be considered by the delegation as well. The delegation will also visit localities inhabited by persons belonging to national minorities – Nemenčinė and Kirtimai.

The delegation is to hold meetings in Vilnius with representatives of the relevant ministries, members of Parliament and representatives of other bodies/departments, such as the State Commission for the Lithuanian language. Meetings with the Office of the Equal Opportunities Ombudsperson and the Parliament Ombudsperson will be organised. The delegation will also meet the Council of National Communities representing the various national minorities living in Lithuania. Minority non-governmental associations as well as general Human Rights NGOs will be met by the delegation.

The delegation consists of two Advisory Committee members: Mr Alan PHILLIPS (President of the Advisory Committee elected in respect of the United Kingdom) and Mr Ferenc HAJÓS (member of the Advisory Committee elected in respect of Slovenia), who are accompanied by Ms Artemiza-Tatiana CHISCA and Ms Eva KONECNA from Secretariat of the Council of Europe.

Note: Lithuania submitted its second State Report in November 2006. Following its visit, the Advisory Committee will adopt its own report (called Opinion) in early 2008, which will be sent to the Lithuanian Government for their comments. The Committee of Ministers of the Council of Europe will then adopt conclusions and recommendations in respect of Lithuania.

Bulgaria submits its second Report pursuant to the Framework Convention for the Protection of National Minorities

Bulgaria has just submitted its second state report in English, pursuant to Article 25, paragraph 1, of the Framework Convention for the Protection of National Minorities. It is now up to the Advisory Committee to consider it and adopt an opinion intended for the Committee of Ministers.

National Minorities in Montenegro : visit of the Advisory Committee on the Framework Convention for the Protection of National Minorities

A delegation of the Advisory Committee on the Framework Convention for the Protection of National Minorities is visiting Montenegro this week from 5-8 December 2007 in the context of the monitoring of the implementation of this convention by this country. In addition to Podgorica, the delegation will visit Bijelo Polje, Berane, Rozaje as well as Tuzi.

This visit is taking place less than two months after the adoption of the new Constitution of Montenegro: the resulting legislative framework for the protection of national minorities together with its effective implementation will be at the centre of the discussions.

The delegation will be having meetings with the representatives of all relevant ministries, as well as with the Constitutional Court, the Ombudsman’s Office and the Parliament. In addition to contacts with public officials, the delegation will also meet persons belonging to national minorities and human rights NGOs.

The delegation visiting Montenegro includes Ms Ilze Brands-Kehris (Latvia, 1st Vice-President of the Advisory Committee) and Ms Regina Tavares da Silva (member of the Advisory Committee elected in respect of Portugal). They will be accompanied by Ms Stéphanie Marsal from the Secretariat.
